Hi.

I have a question about employment requirements. My now-husbands SSN card says "Valid for Work Authorization Only." However we have not yet applied for AOS/EAD (in the process of getting required docs together). A friend runs a business & offered him a job - which he took - the owner stated he was certain the SSN was sufficient as he had hired other non USCs. Now we are filling out all the EAD paperwork and it lists present employment - it is ok to list his employment?

i am starting to wonder if we were misinformed by our trusted friend. We want to follow all steps appropriately. What do we list if he's already working? Should he quit immediately?

You should read your husband's SS Card carefully. The card says "VALID FOR WORK WITH DHS AUTHORIZATION"

Your husband, doesn't have DHS (Department Of Homeland Security) authorization yet. He is working illegally.

Quit and not work until legally able to do so, or list the employment on any forms that ask, since you need to be honest and truthful on any immigration form. Be honest again if you have an AOS interview and are asked about it.

I think they were asking about what should they put on the I765 form about current/past employment as they haven't even filed yet.

ah. ok - the penny dropped.

technically working illegally at the moment, now filling out the I-765 for the EAD card application, what to put there.

Untill EAD does not apply, and EAD card does not arrive in his hand , He is working illegally. SSN card or a I-9 form or else will not work.

This happend to me. you can see my timeline. E-verify will not work , just will work by EAD, Then nobody will hire him. If he has a job now from his friend. that is ok good for him but that job in law eyes is illegally.

Working in the USA as Nonimmigrant without EAD is illegal. Moreover, if he uses that SSN to get a job and list it on any form, he will be caught. Also, it is not good to lie to USCIS. He can state the truth and will be forgiven because he needed to work to take care of his family. Don't never lie because when you are caught, your process will be messup. speak the truth and the truth shall set you free!!!

Your husband's situation isn't any different than mine. My SS Card says 'valid for work with DHS authorization only' or something like that meaning i will need EAD to start working.

Your husband cannot work. And if is working, should quit. Make sure there's no evidence in the shape of paystubs, account statements etc because if it is proven to the Department of Homeland Security, you are looking at a lot of trouble. It can even jeopardize the Green Card process. So quit working right now. And do not mention it to anyone, so nobody reports you to DHS. and do not put this in writing, especially the information you are providing for EAD.

The only work authorization is EAD or Green Card. I hope this helps
