Hello guys, I hope everyone's having a great day.

I need help understanding the checklist I received from NVC about the I-864 and I-864A I submitted.

Background: I am a US Citizen, filed petition for my mother (Philippines), paid both AOS fee and IV fee, sent I-864 and I-864A (spouse is the co-sponsor). But yesterday I received this letter in the email:

"Checklist for I-864A (filed by.................. )
NVC has reviewed the financial evidence submitted. However, additional information is required to complete the financial evidence review. Please provide all requested documents and refer to page two for mailing instructions.
General Instructions [x] You will need to complete and submit the new form completely filled out (all pages required), which includes the changes noted below. Submitting single pages of the form with the correction is not acceptable. In order to make corrections you will need to download a new form at www.ImmigrantVisas.state.gov.
Part 1 Information on the Household Member [x] ..................'s income indicated on line 11 of the I-864A does not correspond to that shown on the most recent tax return and W-2(s)."

and the other letter:

"Form I-864, Affidavit of Support, & Financial Evidence Checklist)

Please review the instructions below then refer to the final page of this checklist for mailing instructions. I-864, Affidavit of Support Checklist [x] The Affidavit of Support is an important legal contract between you and the U.S. government. During our review, we identified one or more sections that were either incomplete or contained incorrect information. Please review the additional instructions below then complete and submit anew Affidavit of Support. You can download the I-864 form and instructions at http://www.uscis.gov/i-864.
In Part 1. Basis for Filing Affidavit of Support, please correct the following...
In Part 2. Information on the Principal Immigrant, please correct the following...
In Part 3, Information on the Immigrant(s) You are sponsoring, please correct the following...
In Part 4. Information on the Sponsor, please correct the following...
In Part 5. Sponsor's Household Size, please correct the following...
In Part 6. Sponsor's Income and Employment, please correct the following...
[x] Items 13.a.1.The income you enter must match the total (gross) income reported on your most recent Federal income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.
In Part 8, Sponsor's Contract, please correct the following...
The Form I-864 we received was missing the following page(s). Please ensure you include all nine pages when you resubmit the form.
You must submit the following financial evidence:
NVC Special Instructions
The lines in red are the ones I believe needs to be corrected.. both lines from I-864 and I-864A are the lines where we enter the total gross income for the last 3 recent tax year. I entered ONLY my individual income in all three lines from the last 3 years on I-864 and then my wife also entered ONLY her income on form I-864A. Is this where I messed up? Should we combine both our annual income and enter it for each tax year since we file Jointly on our income tax?

Yes, I got the same one, for the same reason. It's stated "my total income" on the form, so I entered only sponsor's portion of the income (and it matches wages and income transcript) - it actually needs to match the amount on line 22 on 1040. I called them this morning, and they explained this to me (I asked why the total household income if the spouse is not the joint sponsor and I was told that it needs to match the tax return regardless of the spouse signing I-864A or not). I also asked if I need to revise the other two years and they said no. She literally said they don't care for those two years, and that I need to change only what I'm asked to change. Go figure... I did tell them that the instructions are not so clear for 13.a.1 when you file jointly and only one spouse is the sponsor... well, we'll know for the next time xoxo

Thank you Zee Zee!

So enter both our income which is whats on our 1040, got it. And yes I noticed the I-864 Instructions that comes with the form is confusing. Looks like they updated the Form I-864 itself but not the Instructions because some parts and items on that step-by-step were missing or have a different number on the form.

Thanks again!

cEzYcHiC, I just filled out a new I-864 and I-864A forms with the corrections. I did not include any supporting docs. I read somewhere in one of the forums that I don't need to and also the letter says send only the requested corrections.

iKHiNG, I got the same checklist, did you send a 1040? or just a w2? I sent both, original w2 and a 1040. The only problem is that the 1040 is only signed by me, since i had filed for an extension and my wife is still not here yet. The interesting thing is that for 2012 I had sent a w7 to request a ITIN for my wife and got refused, the following week I get a check in the mail with both my name and my wife's name. I just hope they dont give me another checklist, that will add another 30 business to this long wait.
