My fiance left me 6 and a half weeks before our wedding. He is still in possession of his K-1 visa and hasn't traveled on it yet. I'm filing for custody of our son and I'm just wondering how child support works internationally.

He has a very good job at IBM Brazil and my son does not have dual citizenship and does not have a passport. I'd rather not get my son these things until he is much older (right now he's only 1 and a half!)

The paperwork I had started for custody also says he is held to US laws regarding this because he conceived a child in the US and signed the declaration of paternity.

How does child support work internationally? (US/BRAZIL)

7/2010 : Met online
11/2010 : Started dating
07/2011 : Met in person
11/2011 : He visited again
02/2012 : He went home
02/2012 : We're PREGNANT
05/2012 : He surprised me with a visit
07/2012 : He went home
09/2012 : He's back
10/2012 : Our son is born!
02/2013 : He went home
03/2013 : FINALLY agreed we should get married

04/02/2013 : Filed I-129F
04/09/2013 : NOA1 (California Service Center)

04/15/2013 : A# Changed

08/09/2013 : RFE

08/14/2013 : RFE hard copy

08/15/2013 : RFE reply sent

08/19/2013 : RFE received @ CSC

08/26/2013 : NOA2

12/18/2013 : Interview at RDJ

01/31/2014 : Received passport/visa

02/14/2014 : Left for the UK

03/13/2014 : He left me

03/20/2014 : Emailed RDJ

03/24/2014 : RDJ response "Have him send the passport back to us so we can cancel the visa"

04/2014 : Found out about the "other woman" (she knew about us the whole time)

05/2014 : Filed for custody, no visitation, last name change

05/2014 : Cut off all contact. Found out I was just an easy way into the US.

06/14/2014 : Served him with custody papers. Never got a service notice back.

You could read here about International child support

Sadly Brazil is not one the 26 foreign reciprocating countries/provinces for child support purposes.

You might want to consult a international law attorney.

By the way, you should send a letter (or contact) to the US Consulate Brazil to revoke the I-129F, so that his K1 visa would be void for traveling.

I have already emailed them and they said I needed to get him to send in his passport so they can remove it... not likely that he will send it in though.

If you are wanting child support from him usually your state will go after him for it. if your low income they will usually help you. But the only way they can get child support from him abroad is if he is working for a us company. If he's not then there is pretty much nothing you can do. Unless he is willing to pay it on his own to you.

You could also try contacting the CBP and letting them know not to activate that visa

The fortunate part is, even if he does activate it, all that does is give him 90 days legally in the USA. You are not on the hook for the I-134 and he cannot adjust his status without marrying you (which sounds like you don't want to do.)
