i was told that i might be in a adminstrative review..can any one help understand what that means.....my fiance is from morocco and we have been approved of our k-1 then when it came time for interview..they didnt give him visa because they gave him letter of 221g saying that they wanted more proof of our relationship..so i sent it...then in april i got a letter saying they will give me a disicion in 60 days.....but thats come and gone now and ive made many calls to them and they give many 30 days to those.....now i just finally recieve a letter saying that they will answer me up to 6 months time now...has any one been where i am now?????how can we hurry them along????its been over a year of waiting now.......i need to know some answers.can any one help me understand the immigration....?? :help::help::help::help:

oh wow, you have been waiting a long time.

There are others who have been through the AP/AR process who will be along soon to give you a more detailed response, but to start you off,I'll add this. After the interview and approval of the visa, all beneficiaries are pt on a series of secuirty checks. Based on the number of false hits due to name similarities etc, this can take a while to sort out to make sure the beneficiary is cleared to be admitted. Normally in Morocco this can be anywhere from a week to several months.

The secuity checks happen in the department of state and are not related to USCIS and the Department of Homeland Security. My best guess is that neither department really communicates well with each other. You can call the DOS and check on the status of the security checks. Usually all they can tell you is they are still pending, but they can not tell you how long the process will take.

Casa has a reputation for being unpredictable and less than stellar in their handling of cases. so it is a good idea to stay on top of tese things. Since you have received some communicatons from them and have passed some of these deadlines, in my opinion I thinkit is appropriate for you to be contacting one of your repressentatives. EAch Senator and Congressperson has a immigration aide, you should find out who this person is and start to build a relationship. Some aides are better than others so if you do not get help from one, contact another representative for your area. YThey will not necessarily be able to speed up the process, but they might be able to get a more clear answer as to what is happening and if the visa is in limbo, they might be ablel to get it moving again.

If your case was indeed denied and not just pending security checks, you need to contact Chiquita or Kiya by sending a PM to them via visajourney. I don't know Kiya but I have heard she is very helpful and I have known a few people that Chi has helped. Good luck.

kit kat 1 im sorry i didnt explain better i am new at this...yes our k-1 was approved ..yes it was sent back to uscis for further review....but now its been taking so long..no were not stuck in security checks..i didnt have to do anything of the imbra or anything now thats new when i sent in my application in april 2005....thats why im wondering why is it taking so long.......thank you for helping me Ella

Well, Ella. I can't speak about k-1 visa. Basically, we're behind you in filing a couple of month. But the same sh... happened to us. I didn't re-file for K-3, still waiting for somebody to do something. I'm in contact with the Congress Woman's office as well as Senator's office - doesn't help much.

Tried calling DOS - got only 'all representatives are busy, call back again later" after staying on the phone for a while.

In February it'll be a year since 221(g). VISA PROCESS SUCKS!!! ::blink::(:girlwerewolf2xn::cry::clock::ranting:

It's like what i've heard on the radio another day, a guy was talking about prizes for guessing something and he said, you'd get a Roomba! That's a vacuum cleaner that sucks all by itself! That's what I think about visa process! :ranting: :ranting: :bonk:

I do not understand...am I missing something?? How was your case sent back to Vermont for further review but you weren't denied? My understanding is there are only 3 answers: We need such and such document; You are approved and just need to await security checks ; or You are denied/your case is being returned. :unsure:

Some call consular returns "soft denials".

My experience was I received a NOIR (notice of intent to revoke) letter from USCIS. To me that meant that the consulate wanted to have our case made null and void. USCIS was kind in saying I had 30 days if I wanted to respond to the allegations of the consulte. Problem was they did not include what the consulate had said. They wrote only that according to so and so case (a prevous case in which they quoted law) it appears the benificary does not qualify for the benifit sought and according to so and so (another case in which law is quoted) we intend to revoke your petition.

I responded (and more believe me!) and our case was returned to Casa saying for them to issue the visa. Wish it was that easy though. In the end we did get a visa which is why I suppose many call this consular return a soft denial. In fact it is a REAL denial because many do not get the opportunity of receiving a letter (NOIR) and instead are left in the dark forever or are told their petition has expired and they can refile if they choose to.

Just the facts!

I dont think you are in AP/AR. The letter your fiance recieved would tell you that.

Exactly what does the letter(s) he has received for the consulate say Ella?

hello tanya, yes my fiance is from khemisette... i loved it there it was very beautiful ive been there 2 times so far we had a beautiful ring ceremony the first time i was there....thanks ella :dance:
