Hi,

So I am a US citizen and my spouse is a non resident alien. I filled his petition in Aug 13 and now it has been approved and sent out to the NVC. I am kind of late in filling my taxes, so I think for now I am going to file my tax as "Married filling separately" so that I do not have to apply for an ITIN as the deadline is approaching soon. My problem though is that you cannot get a lot of deduction when the status is "MFS". In fact, I owe some taxes with that status!!Also no EIC or education deductions as well.

Can I go ahead and file the return now and not get any refund (because I need the tax return for the affidavit of support document), and then once he is here change it to married filling jointly and use his SSN and get the refund?

Thank you!
