Hello all,

I am contemplating travelling to Houston (where my case was transferred) in an effort to speak with someone regarding my case. I am at 11 months now (Notice of receipt: 2013-04-18) with no information given whatsoever, case status still under initial review.

If there is a problem with my case I feel like I should at least be aware of what it is and have the opportunity to address it. I tried to speak with someone at the local office in Charleston, SC but they were surprisingly unprofessional and condescending. The office basically told me he had no more information than I had and I was wasting my time inquiring about my case.

Does anyone here have any experience with a similar situation?

yes I understand your frustration!! have you contacted your local senator or congressman? most likely they can look into your case now since it's at 11 months. I contacted mine at 7 months and they have done their best to get answers.

Please remember all cases are treated differently. where as 1 person gets approved at 5 months and another person may wait 2 years.

I know our case is slightly different because I applied for I-130 but I am someone who has been waiting for a year and a half, so it happens :(

There are plenty of things you can do to find out more answers about your case. You can call in and ask for a Tier 2 Officer and then ask your questions. You can contact the USCIS Ombudsman to get some answers from him. You can put in a Service Request. I know as a last measure you can get your Congressman involved. None of these require that you move.

Having gone through none of these things, I don't have any concrete tips that I can give, but I'm sure others will come along and help out.

You can call the USCIS and ask to speak to a tier 2 immigration officer that has access to your case file. Put in a service request for being well past the average processing times. Contact your congressman and/or try the ombudsman > http://www.dhs.gov/case-assistance

I cannot think of anything. I had a background check done on myself and it came back with nothing. Met my fiancee during a J1 summer work & travel program. I have visited her every few moths overseas since. Seems like a basic case. Should I look into family members criminal records?

  1. Was there anything unusal about your case? Perhaps the last name may have thrown a flag.

Actually, No. I am not sure why I believed that. It is possible when I went for my INFOPASS appointment they told me that it was in Texas though so it is possible.

This is the text of the communication I received when it was transferred.

On July 10, 2013, we transferred this I129F PETITION FOR FIANCE(E) to another office for processing because they now have jurisdiction over the case. We sent you a notice of this transfer. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Thank you. I spoke with a tier 2 person today and they informed me my case was in Texas and encouraged I email them as they are only giving generic replies to my requests for action.

I am sending an email now with more flight info, photos, etc. Hopefully it will get through.
