I have no clue so I'll just ask the question.

The children are already in the US. The parents go home but the children stay behind with a LPR or USC. Why couldn't a child on a tourist visa be enrolled in private school after entry and adjust status? Why would there be a need to return to the home country.

Please respond with legal, procedural and statistical information only? Don't respond with this is not "correct", "proper", it's "cheating". I don't care whether you believe an AOS is fair or not.

Are you asking about adjustment of status or did you mean to say change of status?

It's people like Jason who makes those of us who have years of experience and knowledge to shy away from assisting others when they could possible be headed for a disaster. I will keep all knowledge to myself and only share it with those who are willing to pay.

Good luck and I have left VJ forever.

Peace out!

Get it? :goofy:

The specific answer is they do not have any basis on which to adjust status. There is no immigrant visa immediately available for them. Any attempt to adjust status would result in the forms being denied for that reason and returned (possibly without the fees). Eventually they would end up out of status and subject to removal.

They want to change status, not adjust status.

Must be horribly confusing to the OP, so many posts that are completely irrelevant.

They can not attend school on a B.

So:

1. Go to school, speak to International Admissions Officer find out what needs to be done.

2. As I get the impression that OP is not really up to DIY, go and see Immigration Lawyer and get the paperwork processed. Seems like OP is prepared to provide Board and Lodging, the Parents can pay the rest.

Makes sense. I think he meant change status but said AOS. I was too tired to notice before but yes adjusting is not an option, and changing is. I would agree about getting an attorney, as B2 -> F1 can be logistically difficult. Many are denied because of the timing. The F1 has to be issued with 30 days of the school start date IIRC, and they have to maintain status until then.
