ok my wife and my lil 2 years old daughter interview was today and i went in with them. when i first did their paperwork it was F2A and their priority date was january 2011. i just had my citizenship last month and their case was already on its way to the vietnam consulate so now after interview the gave my wife the pink slip and my daughter the blue slip saying "when your daughter IR-2 is complette please comeback for an interview." why would they interview my 2 years old daughter? and why do they make me do a seperate ir2 form when she is under her mom and both visas were paid?? im confused please someone help me im stresssing.

Did you also have a I-130 petition sent in for the daughter? If not you have to do that. Was their actually an interview for your daughter or just the mother?

And your daughter isn't under the mom. Everyone who is immigrating has to have their own I-130. Than at NVC she would be assigned her own case# and you would pay the immigration Visa fee for your daughter also.

they only interview me (the sponsor and my wife). yes i believe my lawyer did a petition for my daughter when she was born and i saw she have her own case number, but as their priority date was near i think my wife and daughter case were one.

When you say case# you mean the MNL or you mean the receipt# from USCIS?

At NVC did you pay the IV Bill for daughter. That is the actual Immigration Visa application.

You need to ask your lawyer. They don't combine IR1/CR1. Each immigrant regardless of age has their own petition and application.

You said wife got pink slip is that the 221g or she was approved (I forget what tall the colors are).

You need to call your lawyer.

heck you can log now into the portal and see your daughters case# and see what was done. Or did you give lawyer $230 for wife and $230 for daughter (the $88 would cover them both)

pink slip is approved while blue slip is more documents needed. yes her IV bill and AOS were paid even my daughter has her own case number its XXXXXXXXXXXXXX but i was a permenant resident when i petition for both. i just had my citizenship last month and now they say my daughter cant derivates with her mom. thhey say i have to file with uscis for my daughter.where is the portal website so i can check?

This is very confusing. Can I ask why aren't you dealing with your lawyer because he screwed this up.

Sounds like fees were paid at NVC (how I have no clue) But no I-130 was paid. I will have admin redact your case# no need to put in personal info.

Nothing has been done on your daughters case that is wat the issue is. It's still sitting at NVC. You need to be calling your lawyer now and right now. Sorry.

I did called him and he told me to go back there and ask what doucuments do i need cuZ it seem he paid the fees for my daughter. He did both i130 for wife and child but its weird my daughter case is at nvc right now even though i paid for her visas last time

I would (not lawyer) call NVC you need to fix this. For them to say they need IR2 for child means the IV Bill fee was not done no DS-260 was done for your daughter is my guess. Did you fill one out or was that for the lawyer to do.

Thats whats missing. You need to talk to NVC and ask for a Supervisor. They are open until Midnight EDT.

Thanks wheel u been very helpful bro! Yes my wife sign the ds-230 part 2 (old version of ds-260 now) for her and daughter yesterday at interview which mean they did ds230 for both already.

You are welcome. I feel like flying to USCIS or NVC or embassy myself. Thank God you are still there maybe go back to embassy and ask them what is going on. How is it you paid all this and they say this. Please keep us posted. This is very interesting (I know not fun though). Praying for you.....by the way I am Debbie :luv:

When you file for F2A - your spouse and children can be included on one I-130 - but it has to be seperate once you upgrade it to IR-1/2. They each need to have their own petition with two seperate IV and other fees paid at NVC ...They cease to have the derivative benefits..!!

well i did file 2 seperate petition while i had greencard, both visa and aos fees paid and both did ds230 , i still have reciept

ok guys i got it situated, i went to the consulate today and it seem my daughter case is still at nvc, nvc didnt know i had citizenship last month so they think my baby derivatives with her mom when i file f2a category thats why they didnt send her case with her mom back . US consulate told me to call nvc and send my daughter case to Ho Chi Minh for my daughter interview hopefully it wont take long and im leaving back to the state on april 16.......guess im going home alone.

Call NVC ask for Agent Gus (you may get him he is the best knowledgeable person at NVC). And request an expedite for your daughters case to embassy. State your wife already is interviewed and done waiting on your 2 year olds casefile. Hopefully it shouldn't take long the 16th is a ways off keep hope alive. Glad it was straighten out though and you found out what was up.
