No stamps in passport

We are filing for a K1 visa this month but have come across a problem that seems unique to Canadians. I do not have stamps in my passport as proof of entering the US to visit my fiancé, as Canadians do not get stamped at land crossings. I also have recently acquired a Nexus pass and there is no option to ask for a stamp with this form of identification. I have request my entry/exit records from CBP but they take 6-8 weeks to arrive. My question is: did anyone else have this issue and if yes, what did you do to remedy it? Thank you!

I went to Vietnam to see my wife couple times with Vietnamese visa. However, when I came back to States, I have never got passport stamp on my passport from all those trips. It might be that they change to electronic system now or the CBP was lazy. Because I got stamp when I was back from France but not for coming back from Vietnam.

I have my Vietnamese visa along with boarding pass and photo to prove that I have been in Vietnam. I was nervous that USCIS will require the stamp passport so I requested CBP on July 2013 to provide the information for those trips. CBP still never gave it to me until now lol. However, my wife got approval on NOA2 and interview without those stamps.

Did you flight or drive to US? so It might be different for you.

Yeah, they don't always stamp the passport. Hopefully you have other things to show proof of seeing each other.. .like photos, receipts, credit card statements, etc.

IR1/CR1 Visa - We are using a lawyer!

Embassy: Montreal, Canada

USCIS

22 Jan 2013 -- packageSent
31 Jan 2013 -- NOA1 from NBC

6 Mar 2013 -- I130 transferred to Orlando local field office (which started the whole nightmare)

Mar 2013 to October 2013 no one would tell us where our case was or what was happening. I suspected the whole time it was just sitting in a corner somewhere in the Orlando field office. I was pretty much right.

October 2013 - get congressman involved. Congressman asks USCIS repeatedly about our case but they won't even tell them anything.

31 Jan 2014- finally get NOA2!!!! (we think the nightmare is over!)

NVC

Our case was not sent from the Orlando field office as it should have been. The nightmare continues. We kept calling NVC and asking if they received our case, and they always said "NO" and that we had to wait 90 business days for it to be received. We called USCIS during this time and they kept telling us it had been sent. After the 90 days of agonizing frustration, NVC then started telling us we had to wait 120 business days. I got our congressman involved again, and they told the congressman it was sitting at the Orlando office this whole time (just as I thought it was!).

22 Apr 2014 -- NVC received
16 May 2014 -- NVC case number assigned
24 May 2014 -- AoS and IV bills paid

28 May 2014 -- Sent AoS and IV Packages

6 June 2014 -- documents scanned

18 July 2014 -- false checklist from NVC

21 July 2014 -- Case complete

28 July 2014 -- receive case complete email from NV

30 July 2014 -- interview booked! September 11 here I come!

Embassy
04 Sept 2014 -- Medical
11 Sept 2014 -- Interview - APPROVED!!!!
15 Sept 2014 -- Package arrived at Loomis location!!!

**03 Oct 2014 -- POE!! **

I NOW LIVE IN OCALA, FL!!!!

Thanks for the replies!

I feel we have plenty of other evidence and I do have the dates written down that I was in the US, which I will submit (for what it's worth). I'm not too terribly worried on that front, however, since we were blissfully unaware of the process when we started dating, we did not keep receipts or trip itineraries. I always drive as I live close to the border so no boarding passes to submit. We shall see what transpires!!

I can't believe CBP has still not addressed the request you submitted Anonymous885! Actually, on second thought, yes I can believe it! haha

I did make that request but the issue was that they take 6-8 weeks to process and reply. From reading Anonymous885's post, they don't always come through though!

I have just checked my FOIA request on July 2013 and it is just in the process of choosing the agent CBP to work on this request. It was taken couple months for them to touch the request lol. This is ridiculous!!.

They come through eventually. However, I really don't think it is necessary. USCIS can confirm dates with CBP, if you provide the dates; POE may be helpful too.

I requested K1 records via FOIA about fifteen years ago … took about six months then to receive the documents and I received records from other applicants in addition to the ones I wanted … very strange.

If question is regarding whether I had an issue evidencing that I saw my girlfriend within the last 2 years enlight of no passport stamps, then yes I had that issue. If questions is I had problems getting record, then I never got them so I can' tell you.

My situation is simillar to yours. I am from Los Angeles and travelled to see my girlfriend in Baja Cali., Mexico.

What I did is as follows: I turned in picturs of five seperate dates that I saw her in person. The pictures were of her and I together. The last two pictures were supported with reciepts [that had dates] show the very event that we were doing, i.e. a reciept showing we were eating tacos at a restaurant with a picture showing us those tacos. In one picture I show her podinh with the sweat pants nexty to her that I bought her [that I bought in LA] and took to mexico. I place a copy of that reciept in package. I even appeared in the picture. To show we were togather.

I also explained it in the addendum, to the question of whether we met in the last two years, that they don't stamp passports when you travel by land (I am sure they know these but it is good to explain). At the end I tried to creat CIRCUMSTANCIAL evidence to show I was there with her in the last two years.

Good Luck.

I never had stamps in my passport either from when I drove to Virginia and we got approved back in 2011. I did have other receipts of proof of going there such as hotel receipts, gas reciepts from the different states on my route down.

Finally, I got an email from CBP this morning and this is how they reply

"Your request for Expedited Processing for the FOIA request CBP-2013-024538 has been denied"

There is no explanation on why they denied

Dont reply on them so much.

Welcome to the forum.

There is no need to fixate on what relationship evidence you don't have, concentrate on providing a good blend of the other types of relationship evidence as mentioned in the VJ Guide:

http://www.visajourney.com/content/k1guide

Good luck on your visa journey.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)
