My brother died after receiving IV packet and visas.I want to know form VJ kind member that Now after the death of Pricipal Applicant my brother wife and his two childrens can enter USA.Plz reply me.I shall be very thankful to you all.

hi

only for widows of a USC, they are immediate relatives

but spouses and children, which are derivatives in siblings or married children's petitions aren't covered. they depend on the approval and interview of the primary beneficiary

Sorry for your loss. Your question was answered above, the answer is no. If he has died they have no path since they depend on him to get here. once again the answer is no, they are derivatives of the beneficiary and they cannot come here without your brother. Their visa journey ended the day he passed away.

I'm sorry but I didn't realize that they already had their visas in hand, they should contact an attorney because probably immigration at POE will ask for the beneficiary and since he passed away

I'm not sure if they will let them enter the country, and why waste money if they are going to be turned back at POE? they have to find out if they can enter or not, without the primary beneficiary

found a case from an old thread

The derivative beneficiary could not use the visa issued to her after the principal beneficiary died before immigrating.

The positive news is that humanitarian reinstatement is possible
