No citizenship,Passport expiring by the end of the year, army duty and k1 visa....help please?

Hi everyone,

I am preparing to file for the k1 visa to bring my fiance over. Due to some crazy circumstances he currently has no citizenship, he is in the process of getting Korean citizenship (he's Korean by blood) but living in the UK. If it goes through his Korean passport will expire at the end of the year and he needs to return to Korea to join the army. It's mandatory.

We got engaged last month and want to bring him here before the year is over, however I think the K1 visa might not work out since his passport will have less than 6 months left by the time they issue the visa and we aren't sure if he can renew it. Is there any chance we might get approved anyway? Is it possible to get the visa by December? If it takes longer than that, can he come to the states before his passport expires and we wait for it to be approved? Or is there any other visa that would fit our circumstances?

Any help is appreciated, we are so confused at the moment.

If you want to get the visa by the end of the year, you'd be wanting to file NOW.

As to the citizenship/ passport.... can you tell us more about why he has none? For example if he is a refugee, he should be able to get travel docs that way to whcih a visa can be attached.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

How he doesnt have citenzenship?

You say that he is korean by blood, but maybe he is uk citenzen then.

Anyway I think that if you send the papers now he has the chance to have his interview in december.

But it isnt sure, because this process can be fast but can be long.

I can't go into much detail but he isn't currently a citizen in the UK, it was revoked due to something someone else in his family did. He was given the option to get Korean citizenship but it's processing now. I don't really think he counts as a refugee though.

So what Citizenship does his Passport say he i.

He doesn't have a passport at the moment, he should be getting a korean one soon.

If he is going to get one soon, maybe his passport wont expire for th end of the year.

Almost all country give passport with a validity period of 6 or 7 years.

The korean passport will be good only for few months?

Why his passport wil be only for few months?

The embassy told him that it's only good for a few months because in Korea after 25 you can't leave the country until you fulfill the military duty. He's turning 25 (korean age) this next year so the passport is no good past this Dec 31st since all Koreans turn one year older on New year's Eve. They say that the only way to extend the passport is to study a masters/phd (which he can't afford) or get a green card. We chose the fiance visa because once he enters the country it doesn't matter if his passport expires and he will be on the way to getting a green card.

You need fill out the k1 this month then.

I think that you can be fine and he has an interview before december at uk.

He need be legal resident at uk for has his interview at uk.

Send the patition with all documents required and photos and everything to avoid rfe.

If you get rfe, that can delay a little the process.

Read very well the instructions and send to uscis a good packet.

Before send the packet, pray to God over the packet, present the packet to God, and you will see he will make the things move quick
