Hello,

I'm actually not new to this site. I used you guys for my previous filing, which is exactly the reason for my question. I'm beginning to file an I-129F for my fiancee who lives in Brazil, and although I feel pretty confident I have everything ready and correct, I have one question that has stomped me. Part 1 - Question 14: "Have you ever filed for this or any other alien fiancé(e) or husband/wife before?"

Here is the background on the reason why I'm stomped:

I was married in 2004 to a Dominican national (from Dominican Republic, not Dominica the island), and obviously we had to go through the filing process as she was not a Legal Resident of the US. This is kind of the timeline of that relationship:

1997 - Met each other for first time

2002 - Started dating (Long distance relationship)

2003 - Got engaged (planning to do a civil wedding in the summer of 2004 in Elizabeth, NJ and the big church wedding in Santo Domingo, Dominican Republic)

June 2004 - Got married in Elizabeth, NJ through a civil ceremony.

December 2004 - Due to some circumstances the Church wedding was moved to Summer of 2005.

July 2005 - Church wedding

October 2005 - She came to the US using B-2 Visitors visa, but once here we decided to start an AOS process, so I filed an I-130, I-485 and all those other forms.

By June 2006 - Everything was approved (Interview went smoothly in May, 2006) and she received her temporary Resident Card.

June 2008 - Filed for Lifting of Conditions.

August 2008 - Due to irreconcilable differences we separated.However, still lived in the same apartment and actively went to couple's therapy to try to resolve the problems.

By April 2009 - All was approved and she received her 10 year Permanent Resident Card in the mail.

February 2010 - After many failed attempts at counseling and couple's therapy, I finally filed for divorce in Suffolk County, MA.

November 2010 - Went to court and she was a no-show and hence I was awarded the Divorce in MA.

January 2011 - Divorce became absolute.

Here is the timeline for my new relationship:

December 2012 - Met my current finacee in person for the first time in a trip to Brazil for a Wedding that I was attending as the best man.

October 2013 - After keeping in touch throughout the year, she came to visit and we started a relationship.

March 2014 - After 3 trips to the US for her (where she met my mom) and 2 trips to Brazil for me (Where I met her whole family), I asked for her parents' blessings and proposed to her.

I no longer talk to my ex-wife, nor do I want to, since things did not end up that well between me and her. So, in form i-129F Part 1 Question 14, I really don't know what to answer. Obviously, yes, I have filed for a previous Spouse before, but it wasn't an i-129F, it was an I-130. So that's my confusion, are they asking if I have filed for a I-129F, K-1/K-3 Fiancee visa for a previous Alien fiancee or spouse, or do they mean have I filed ANY other form for a previous Alien Fiancee or spouse?

In the case that it is ANY other forms (as in my case the I-130), then, is it very imperative that I have to put her Alien Number? My Ex-wife is now a US-Citizen and she has since remarried to another US Citizen, and I no longer have any of the Filing papers since she took all that paperwork with her. What do I do? I don't have very few of that information for Part 1 - items 14.a. to 14.h. And particularly 14.h is tricky, because even if I can get the rest of the information, what do I put as the result? "Approved Temporary Resident Visa"? or "Became US CITIZEN"? I NEED HELP!!!

Thanks for anyone who can shed some light, and pardon the long message, I tend to give too many details and talk too much sometimes! :P

It asked if you have ever filed any petition for any other fiance(e) or spouse, ever. It does not ask if you previously filed an I-129F. So, you must check yes, as you filed an I-130 for your previous spouse. Fill the info you know. Leave blank the info you do not know. The result of the petition was that it was approved and she received permanent residency.

Thanks so much for your answer! I decided to put pride aside and contacted my ex-wife and to my surprise she was very nice about it and gave me the info I needed. Thanks again for your input! Now, let's start filing! Wooohooo!
