Permanent Resident Wife Left Country - Need Divorce

If you want a divorce get a divorce don't wait for the other party to start

the paperwork. If she left the country you can get divorced with or without

her consent. Its called abandonment of the marriage you need to check you

state laws and proceed, my experience tells me that the longer you drag

this out worse case scenerios could happen. She does have a permanent

green card you know, this allows her to do anything you do as far as

come and go from this country even after divorce. My recommendation

is to see an attorney and get if over with and move on!

When I divorced my ex-wife (and she was already back in Moscow), I filed the divorce paperwork in the court here in the U.S.

They asked me to send her a copy of the paperwork and have her sign it. She sent me an email saying that she had received the paperwork, but had no intention of signing it. (She never said why...dunno if this would have caused her problems in Russia or what.) There is an ugly requirement in some states (including the one I was in) that she would then have to be *served* in Russia, and there's some rules and expenses about how to do that. It was starting to look like I was just going to have to fly over there and do it myself. When my attorney and I came in front of the judge, the judge said "how do you know she received the paperwork?" The attorney said, "she sent an email, here's a copy of it". The judge said, "then attach the email to a motion document and I'll accept it as her statement." Just like that, we were done. I was given a divorce based on abandonment.

There is no such thing as a "simple divorce" when dealing with someone in the Russian Federation. Get an attorney. File in the U.S. Get it started so you can be done with it and get on with your life.

Thanks for the responses. The thing is, I'm not willing to pay for an involuntary divorce (on my part). I agreed to give her the divorce if she paid all costs, and didn't ask for anything. Maybe some time down the road, if I'm concerned enough about it and she hasn't done it yet, I'll file. But I'm not wasting anymore of my time or money on this ####### with her.

what if something happens to you in the meanwhile, and you are not divorced.. all your estate/money/social security will go to your estranged wife :whistle:

That will certainly make her very happy
