Hi VJ's Members,

I have submitted I-485, I-131, and I-765 for my wife who came to US under K-1 visa. I have to go to France every Summer ( 3months) for working and my wife just came to US few weeks ago. I am sure things will be difficult for her to live in Florida by herself. We decide that she will come to Michigan to live with my aunt while I am oversea, and of course, she will come back to Florida when I am back to States. I have to fill out AR-11 for her and I-865 for me. Here are my questions:

1) For AR-11. There is a question that asks she is in the US as a visitor, permanent resident, student, and other.

Do I check the permanent resident even we just got I-797 for I-485? or I have to check the other and put down K-1 visa?

2) For I-485. I will be in France for only 3 months but I have to fill out this form

There is a question that asks for my new home address. I have to write the France's address, right?

They ask for phone number which I do not have it yet and I did not buy the sim card last few times I was in France because I do not call anybody except my family's members who live in States (using FaceTime).

Can I leave it blank for the phone number?

The other questions are my mailing address which I want to put down my aunt's address where my wife will live at. Of course I will not have the phone number too since I live in France at that time. Can I leave it blank again for the phone number?

3) Lastly, This is my most concerning question. I do not know where to send my I-865 to because they only show the address for people who live in US only. I will call USCIS later to ask them but if anybody has an idea, please share it with me . Anybody has an experience with this?

1) I would say Other

2) The I-485 is for the beneficiary to complete not the petitioner, I thought you had already filed this though?

3) Is your US address still valid? If so I don't think In would bother temporarily changing the address on your I-864

You do realize that you are going to have to attend your wife's interview and demonstrate your marriage is bona fide to the IO? That may be a little difficult if you are going to live in a different country for an entire season just after she arrives in the US.


Why isn't your wife going with you anyway?

2) Sorry, It supposes to be I-865 not 485.

She does not have AP card to travel oversea and I would not let her going to France with me because she will get bored due to no job in France for her. If we have to do the interview, then I have to flight back to US to attend the interview. I will explain my situation to IO why I have to go France every Summer.

First at all, I am really tired to stay in France for whole Summer for every year. If It likes 2 weeks for vacation, then I might enjoy it. Otherwise, I would not feel to stay oversea for that long for work.

Secondly, I dont know if she can come to France on her Vietnamese passport. I assume it will be difficult to apply tourist visa for her. Also, she cant go back to US because she does not have AP card.

Lastly, I was thinking to apply CR1 instead K-1 but the paper works to get married in Vietnam are complicated and difficult because it runs by communist goverment ( money goes first ). Anyone who was married in Vietnam does understand what I am talking about.
