Good morning all,

hope you can give me some advice. One of my friends came to US on a tourist visa and had 6 months on his I-94.

He then applied to extend his stay for another 6 months. He was never given a reply form the immigration.

When you look online it still says that it is in process. He stayed in US for 8 months and then had to leave because his father died in Europe.

When he was leaving, the immigration officer did not say anything about overstay.

This was about 2 months ago and now he would like to try to come back to US. His original visa is good for 10 years, so he doesn't need to go back to the embassy.

In your experience do you think he will have problems reentering the country? What documentation he should bring with him?

Any and all help is appreciated!

There are no immigrations offices that would say anything during departure. Yes - he can have problems re-entering the country - not only due to extension but amount of time he spent in US and time after he is trying to return - but will not know until he tries.

He will be questioned about length of stay which appears to be that of a LPR rather than a tourist. If the officer determines he has abused the B 2 or is attempting fraud he will not be granted entry. When he tells his story it will confirm he had no intention of leaving until sadly his father died.

It would be pretty risky to return now after only being gone for 2 months. Even if he didn't overstay (not sure what his status would have been while waiting for extension) his return after only 2 months being gone will be a red flag. They will immediately assume he is working in the US. If he decides to try it he should have really good proof of ties to home.

What would be the reason for his visit?
