Hi All,

I'm very upset today. After waiting a full year and 12 days. My wife finally had her interview today and they denied her visa. They gave her a document that said "Your petitioners income is not enough to sponsor you. A joint sponsor is needed." It was asking to send a recent i-864 from a qualifying sponsor. They also kept her passport.

So my questions are?

1. How long will it take once i submit the affidavit of support form and necessary documents?

2. Why did they keep her passport?

2. Does it mean i have to go through the whole filing process again?

Thanks,

Khalil

hi

she hasn't been denied, only delayed. send the requested documents and she will be approved

that's why they kept her passport, send the documents as soon as possible so they can stamp her passport with the visa

That means they did not deny her, they just put her case on hold until they get the necessary sponsor papers. As soon as they have the affidavit of support, the visa will be issued. No, you do not have to go through the whole process again.

I have not seen this particular case before, but I was present when someone got their case postponed for lack of family ties evidence, and someone else for an expired police certificate. Both were told the visa will be issued immediately when the consulate has the necessary papers in hand.

Please arrange a joint sponsor and send in their I-134 and I-864 (along with IRS transcripts, employment letters etc) ASAP.

And as amply explained by other members, your case is not denied and you do not have to go through the whole filing process at all. The sooner your submit these documents, the sooner your case resumes.

But please make sure that yours and joint sponsor's income is sufficient. collectively it should cover

1. You

2. Your dependents / Wife

3. Joint Sponsor's Dependents / Wife

If need be, you can also seek help from a second joint sponsor as well..the joint sponsor does not need to be a family member.

Hi Brother,

The faster u send the new supporting docs they requested the faster they will process them. We were in same situation and I arranged new docs within 14 days however it took embassy 30 days to approve them. Since she is a female hopefully they will issue the visa soon my husband is still waiting do to AP its been 18 months since interview.

As everyone said your petition hasn't been denied i would also say it wasn't denied

did your wife receive 221G white paper or green if it's white only it's for the Joint-sponsor

if it is green that means you have to go through additional administrative processing

you are probably not aware what it is, you need to research more about it

reason her passport was kept because once you arrange 3 years joint-sponsor papers

they can review it and issue her visa. you need to read about the poverty guideline on USCIS

website that how much income should be sufficient depending on the number of

dependents where embassy easily can accept it, i pray that your wife receives her

visa without being put on AP, All the best bro
