I never ceases to amaze me how many people don't plan for AOS fees in advance. If you're waiting for him to find employment in order to earn the money for AOS, you will never be able to AOS. He will be out of status and if picked up by border patrol or ICE, your problems now will pale in comparison to what will happen if he's detained.

I agree. I think at the K-1 interview, this should be discussed, just like at an AOS interview the IO discusses ROC. At a K-1, the person should be given a piece of paper with the requirements for AOS. My best guess for the reason they don't already, is that it is different agencies doing these things (DOS for the visa and USCIS/DHS for the AOS).

Why don't they just require the AOS fee ahead of time or at least some sort of escrow for it? I think they really need to raise the income requirements for the I864 as well to help address issues like this.

That would be a good idea except that sometimes people don't get married or they do get married and decide to leave the US together. Even though that is not the point of the K-1 visa, it is perfectly legal.

Escrow is a decent idea, keep it for people to use, and if they don't get married, they could ask for it back, but that would also cost USCIS much more money to manage all that, and it would make fees rise.

The requirements are really low, dangerously low, but poor people should be able to live with their families too. It's just another example of how you need money to make money.
