Timeline

Without AOS, he cannot work, cannot travel, cannot get a driving license, and is basically relegated to sitting around at home. I highly suggest that you borrow the money for AOS.

This is a known cost and should be budgeted for. He cannot work until after AOS is filed, so his lack of job at this point is expected.

Thanks for the response. It's not going to take long for us to have the fee. I just wanted to make sure that it is ok to apply for AOS after the epiration date rolleyes.gif

I think he will be ok as long he stays inside the US, because we are getting married within 90 days as promised before his I-94 expires. Thanks for your time! smile.png

As a rule, from my experience anyways, being "out of status" is not a problem unless the person is either participating in questionable activities or being located in an area of questionable activities. My gal got to the US in april of 2009, we married on july 17, 2009, her I-94 expired on July 20, 2009. We waited to apply for her AOS until Feb of 2010 and it was not a problem and she didn't even get an interview - she was upset about that... But, then again she was a "good girl." As long as you married within the 90 day period waiting to file the AOS for even a year or more will not be a problem as long as the person is a "good" person. Even if the person is detained by law enforcement as long as the AOS petiton has been started or is started there should not be a problem. Just my experience.

I never ceases to amaze me how many people don't plan for AOS fees in advance. If you're waiting for him to find employment in order to earn the money for AOS, you will never be able to AOS. He will be out of status and if picked up by border patrol or ICE, your problems now will pale in comparison to what will happen if he's detained.
