Hello VJ members,

I have been living in Georgia (the country) with husband since April of 2013. It will be 1 year next month. My husband and I have started preparing our documents for the next stage (NVC) when we will receive our NOA2 approval. I have been here on a tourist visa for almost one year, and I applied again for one year last week. I am only on tourist visa until the day Jaba receives his visa and can come home with me. And if everything goes right, and with the correct analysis we have 4-5 months left till we complete everything. That being said since I am on a tourist visa, do I have to prove U.S. domicile? or does this only apply for USC's who have been away from the U.S. a long time?

you also have to prove that you can financially support your husband, you have to be over poverty line(check poverty lines on Embassy website)

the proofs you have to show include: tax returns for the last at least 2 years, W2s and paystubs, letter from employer, if possible

btw I am from Georgia too and now I am with my spouse in the US. we went through K1 visa

Thanks you very much, i am beneficiary Georgian citizen my wife is petitioner,US citizen. We are waiting for our approval of I-130 which is near based on spreadsheets. She went in US for looking her family and gathering proof of domicile. Do you recommend us something special she can establish in USA!

Here are some things she can gather that help prove domicile or reestablishing domicile.

Driver's license in the state you will be living, with address of where you will be living preferably

State voter registration card

Utility bills in her name in the house or apartment you will be living

Bank account statements

Credit card statements

Lease for the house or apartment you will be living

If you don't have a place to stay of your own, but will be staying with family for example, then you should have a signed letter from the owner or renter of the property indicating they have allowed you two to live with them until you find your own place

In my situation, I had the family member we will be staying with also provide proof that she is the owner of the apartment through the Closing Statement from the home purchase, mortgage statement and receipt for condo fees being paid.

She should have a letter from an employer, or if she is self-employed she should provide proof of incorporation of her business entity if applicable

These are just some examples, but you want to submit enough evidence that prove her ties to the United States and the area you will be living. There is no cut and dry 'domicile requirement' that indicates what exactly is required, but it must be enough evidence to show that she intends to re-establish domicile or has maintained it.

In my case, I didn't have much of a problem since while living overseas I had all of my mail, bills, etc. from American banks and financial institutions continue to be sent to me in the United States. I just had to change my address on my voter registration from absentee voting abroad, and put a new current address where we will be living on my American driver's license.
