K-1 Fiance Visa Process Starting from scratch

sorry for the misinformation, but pretty much anything I've ever read on here has said "having a plan to get married while on a tourist visa is considered fraud, Don't do it, you'll be turned away at the border, yadda yadda yadda." I'm following the K1 process because I don't want trouble with the gov't and my future husband. Perhaps the big issue is marrying and staying. Maybe that's where the difference is.

K1 Visa timeline:

02/01/2014 - mailed our petition

07/25/2014 - Johan arrives in Los Angeles!

08/02/2014 - AOS, EAD, AP applications mailed. 

11/17/2014 - K2 gets an interview waiver letter in the mail (dated November 12th) (K1 has never gotten this letter)

08/24/2015 - Green cards are FINALLY in hand after nearly 13 months of waiting.

05/01/2017 - ROC application sent 

05/02/2017 - CSC receives our package

05/03/2017 - Official NOA1 date

05/10/2017 - MO cashed at our bank

05/12/2017 - NOA 1 is in the mailbox.

05/20/2017 - Biometrics letter in hand

05/31/2017 - biometrics appt (Oxnard, CA)

06/19/2018 - ROC still pending with no news but that wonky glitch back in February, so we went ahead and filed for citizenship

06/19/2018 - N-400 application filed online

06/20/2018 - NOA1 received online for Naturalization application

06/25/2018 - Biometrics notification online (PDF Document)

No problem :) It is very confusing. Anyone can get married on the US. It's totally fine. It's just that people can't have a plan to marry and then stay on a tourist visa.

This is wrong.

OP: Oh dear, already a lot of wrong information in this thread.

You can come and get married in May. You do not need a special visa to get married. However, you cannot move to the US on that trip. You can come and get married and then leave, as you had planned to do, in accordance with your tourist privileges.

Then you can start the spousal visa process. First, the US Citizen will file a petition that establishes a marital relationship between you two, then the petition will be approved and do some stuff at the National Visa Center (NVC), then you will apply for a spousal visa in London. Once approved, you will enter the US and you will become a Permanent Resident upon entry. That whole process will take 8-12 months.

- So do i need to change my name before i start filling in the IR1/CR1 forms? It would have to be done once i retunred to the UK though of course as the plan is always that i come back.

- ALso can i visit the US at all during the visa process even if its just for a holiday?

The visa name will have to match the passport name. So you can either change your passport, or apply in the maiden name. You can get a GC in your married name later down the line (when you file to remove conditions, something you do when the initial Greencard expires).

You can still visit while the visa is processing, in accordance with your tourist privileges.
