Dear Visa Journey Members,

This is my first post on the forum. I have been only reading and using all your recomendations but, unfortunatelly, it was not enough in my situation to complete my mom's case succesful yet. Please read my short story bellow and give me any help which I highly appreciate.

Consulate: Kiev, Ukraine

Visa: IR5 (Mother)

USCIS recieved my mother's I-130 on 4/22/13. In seven moths it was approved and transferred to NVC. I got the NVC number and fieled DS-261 (Agent of choice) with no issue. Then paid all fees, filed/send I-864ez and filed DS-260. They sent me AOS checklist and requested civil documents which I sent immediately.
At that time everyone started talking regarding political situation in Ukraine and I honestly started panicing because of possibility of state of emergency. NVC representative recomended me to send email request to expedite our case. Accordingly to my research "expedite process" could be approved because of health issue, or family situation...etc Perhaps, I didn't belive that they would approved it but they actually did and mailed my case immediatelly to Kiev. Then I recieved the instructions from USA Consulate in Kiev that I should go on their web page, create an account and schedule an appoitment. I did all of these steps on 3/17/2014 and scheduled next available appointment on 3/19/2014 (in 2 days!!!). Simply put, when my mom showed up at the appointment everything went good but officer mentioned that they haven't recieved original documents from NVC. He took her passport, obtained biometrics and gave her a list of original documents that they need to issue a visa. However, he recommended my mom to ask me to call NVC and contact my supervisor. I called them immediatelly and they confirmed that the docs are there. So I emailed to my supervisor with help request and still didn't get any reply yet.

Please let me know if anyone experienced similar situation. What should we do, should we obtain another originals or wait untill NVC send them over and would they send them or hold? I'm lost! I love my mom, miss her so much and feel so bad that she has to experience all of this.

First, don't panic. All will be okay. My wife had misplaced documents at the Kiev Consular Office as well, but they were identified and made part of her file within a few days. Begin preparing your mother for the next interview by helping her stay calm and making sure she has every item on the list the CO gave her.

As for the troubles, jets are still leaving and arriving Boryspol every day. She will join you ASAP.

My families thoughts are always with Ukraine. I hope all your family remain safe, and peace makes a home in your homeland soon.

I am now in Ukraine. I came to make sure nothing happened to my fiance and her daughters. Time will tell what/if anything will happen. I know that tensions are high here, but life is as normal as it can be.

Regarding the expedite, it is up to you to prove the hardship is on you and your loved one. If everything is already in transit, there really is nothing more you can do other than calling the embassy to verify what the NVC has told you. There could just be a simple delay in processing. Call every day until you get the answer you need. They will get the info. At least the interview is already over.

Hello Guys, Thank you for help.

I called NVC today and spoke to my supervisor. She told me that original docs will be reviewed eventually and will be sent back to me. I don't understand why wouldn't they forward them directly to Ukraine to complete this case? Or they just notify local consular right now that the docs have been reviewed and case can be closed and then return them back to the sender? Supervisor also recomended to me do not wait until they review it, she told me to get sertified copies imediatelly and provide them to the counsulat.

Is there any recomendations how I should proceed to get this done fastest way?

fastest way? you want the fastest way?

have all original docs in Moms Hand , she walks into the IV Unit and hands them over, her hand to a Vice-Consul's hand. It'll mean regeneration of original docs, plus new I-864 on you with all the required docs, as well.

Seems your NVC Supervisor is a bit braindead, you should talk with her again and remind her that the expedite was approved , the interview held, and it's on their office to send the entire casefile submittal over to Ukraine as fast as humanly possible.

Keep reminding her about this, 2 or 3 calls each day....

The thing that chaps my backside on your case, is that ALL OF THE DOCS are already in the SAFEFILE system, and the IV Unit could make an internal decision to use the SAFEFIE version of the casefile, and they are not doing that.

Dear Darnel and Brian&Larisa/All,

Thank you so much for replying here. I just spoke to NVC representative and this gentelmen was pretty cool. He told me that my originals were recieved by NVC a day before they expedited the case to Kiev. He also told me that he was going to put my case on my supervisor's tabe and most likelly averything should be forwarded to Kiev (she hasn't been available since it happened). In 30 mins I got email from another supervisour:

The National Visa Center (NVC) received your inquiry regarding the immigrant visa petition: KEVXXXXXXXXXX filed by VIKTOR YXXXXX on behalf of TXXXXXXX IXXXXX. The NVC completed its processing of this visa petition, and forwarded it to the U.S. Embassy or Consulate in KYIV UKRAINE.

Your case is no longer at the National Visa Center. We sent your case to the U.S. Embassy or Consulate in KYIV, UKRAINE on 13-MAR-2014.


Does it mean that they will be forwarding originals to Ukraine or this mean that there is nothing to forward since everything was sent it already (incomplete case)

I understand that this is usual workflow but it's so unclear and unresponsive.

13 March is a good sign, if'n it actually left the loading dock that day.

I suggest another followup telephone call nowish, asking to speak with another supervisor,

to check the date the shipment left via courier (I think is DHL)

Why is the 13th a Good Day, you ask? It would have hit the IV Unit by now, desorted in the mail room, and routed to the IV Unit, who may have had it on their Friday, at the desk.

Hello Darnell,

Thanks again for your support. I just called NVC again and now was told that when my documents will be reviewed they'll send them back to me. When they will be reviewed noone can answer me even exdedite process has granted. It seems like every single representative has their own scenario in case of this issue. Btw, my supervisor still is not available. In the morning representative told me that she is going to call me back later today but still noone called me who can spill the beans. During my evening call they told me that supervisor is going to call me on Monday. What a mess, she seems like ignoring me.

I hope that my story will be helpful for someone in the future so they won't expidate their process on the middle of NVC jorney only when their case comes right after USCIS.

Viktor - I give a lot of input and do some triage about expedite processes, USCIS and NVC -

I've never, ever heard what you're writing here - that the documents will be returned to you.

NVC is still open, and supervisors are available so I suggest you call, nowish, and talk with a supervisor, any supervisor.

IMO, the answer given is strange, almost untoward, and smacks of 'making stuff up' from a NVC TeleOperator. No, not you - that NVC TeleOperator.

Hello Darnell/All,

Finally, I just spoke to my supervisor and she told me that they haven't reviewed the document package yet because of the amount of corespondence. She promised that when they'll review the docs, they will be sent by DHL to Kiev. She didn't give me exact day but said that it should be soon.

Meanwhile, my mom took sertified copies and very last document will be ready next Monday. Please let me know if we should wait once they recieve docs from NVC or should we bring certified copies? Also, in case of bringing copies should I send email to Kiev to get approval that the sertified copies will be provided?

firstly, anything that you sent to NVC for civil docs,

must be in your mother's hands or the casefile already arrive at Kiev.

second, as to 'certified copies' - man, I don't know.

I know that NVC doc spec is original or certified copies, where the certification is done by the issuing entity/authority.

so if the certification process done recently MATCHES NVC's definition of a certified copy, then yer Mom is golden.

re: police clearance thingie - if it's not difficult to get another one, I say get another one.
