That process would end (as you'd no longer qualify) and you'd then have to begin the process for bringing over a spouse instead of a fiance.

I'd like to know what would happen if my fiance and I got married while the I-129F is in process?

If found out you would be denied then have to start the whole process over filing a CR1/IR1 which is taking well over a year.

I know you may say they will never find out. Maybe yes maybe no. Not worth the risk.

The I-129f becomes invalid as it's for unmarried petitioners only.

You lose any fees you paid as well as time, and then need to submit an I-130 for the spouse and pay for that.

Of course they'll find out. Your marriage cert that you show at AOS will predate your K1 visa. It will be noticed.

I asked the question because my fiance was just diagnosed with stage 4 cancer and is very ill, and I am on my way to him, and I'm so scared. I have all sorts of thoughts about whether he will be granted the visa or not. My world is falling apart.

Hey, sorry to hear that. But at this moment, your fiance's health is the most important thing to you.

Forget about the immigration. Go to him first rose.gif

Done with K1, AOS and ROC

Getting married in the middle of the process will only stop the process in its tracks. If the visa is denied for this now, I would assume it would be denied as well for a spousal visa. I would suggest, while you're visiting, that you get in touch with the doctors who do the medicals there and inquire about how the cancer might affect his approval. Get some real and concrete information before you make any decisions.

Thinking of you and hoping that the situation turns out for the better for the both of you.

The K1 journey:                                                                                                                             The AOS journey:

11/09/2013 - I-129F Packet mailed to Dallas Lockbox                                                                                         06/22/2015 - AOS packet mailed to Chicago Lockbox

02/14/2014 - Case shipped to Embassy, where it waited for over a year at my request                                 11/07/2015 - AOS approved (EAD and AP had already been approved) - there was no interview

05/21/2015 - Interview - Approved

06/19/2015 - Wedding (L)

The ROC journey:

10/12/2017 - ROC packet mailed to VSC

01/21/2019 - ROC Approved - there was no interview

The N-400 journey:

02/16/2020 - N-400 application filed online

02/21/2020 - Paper NOA received in the mail

03/13/2020 - Biometrics

02/02/2021 - Interview & test - Approved

02/05/2021 - Oath Ceremony

Just don't do this. The entire system is set up to identify fraud. They will know, because you will give them documents showing the wedding date. Please believe me, these people are not stupid, lazy or just filling a chair; they take this process very seriously, and the folks at the US Enbassy will deny you in a heartbeat for fraud.

If you want to get married, then return to her country or a third country and begin the K3 Visa process.

There are no shortcuts...

Good luck to you.

Vic & Mark

If you and your fiancee are starting or in the K1 process,

follow this valuable flowchart: link- http://www.visajourney.com/content/k1flow

The process is difficult, but worth all the stress.

Absolutely this. Just go be with him, sod immigration. That can all be worked out when it needs to be. God speed.

Just continue the process.. Just visit your fiancé right now, take care of your fiancé and when everything goes well on your process and you'll get approved sooner (you may request for an expedite) and then you will both fly back to USA and get married there. My thoughts and prayers for you both. Be strong and keep the faith.

Feel sad to know about your fiance's health. I am not too sure if VO will give him the Visa for K1 or IR1/CR1 Interview if he is ill..

I would strongly suggest that your fiance should get admitted in a Cancer Hospital right away without wasting a single day (he should no be waiting for you or anyone and lose time)

I think health should be of utmost importance here, treatment should be started soon. I would suggest to go for a visit visa for continuing the treatment in the US rather than K1 etc.

Just to update you all for all the prayers and concern you've shared for us. My fiance lost his battle at 08:30 am today. I am devastated, but I trust that this is God's will, and he will see me through. Again thank you for all your prayers, and good luck with your individual journeys. Love Nikki
