My fiance arrived with her K1 visa in mid February. We got married on February 18th - wasting no time! Today we went to the Social Security Admin office to apply for her social security card. We thought we could apply for the card in her new married name since we now have a marriage certificate. The guys at the SSA office said that because were now now married, he could not issue a social security card because the visa is only for a fiance. He said further that we would have to go back to the USCIS to change our status to K-3 then apply for an EAD, and then he would be able to issue a card. He wouldn't take no for an answer but I know he is dead wrong. Can anyone point me to documents or something that would help me sort this out? We are now totally confused. I know that changing status to K-3 once you're already in the country on a K-1 and married is just plain wrong, but how to we get her social security card? HEEEELLLPP!! :help:

She most certainly is eligible for a ss card, go to a different office and request a card in her maiden name. I don't believe she will be able to get a card in her married name until after EAD/AOS.

My husband got his SSN a week after we were married, and brought our marriage liscense as proof of address (so they knew he was married).

K-1 (more detail in profile):

05-25-05 - Applied for I-129F

06-07-05 - Approved

12-01-05 - Picked up visa!!

AOS:

12-25-05 - Flight lands at JFK - EAD stamp

05-15-06 - Green card received!! Woo-hoo!!!

05-09-07 - Our first son born!

Removal of Conditions

01-29-08 - Mailed Removal of Conditions Application (overnight)

02-07-08 - Check Cashed

02-08-08 - NOA1

03-12-08 - Biometrics

12-12-08 - Card production ordered! Yay!

12-30-08 - 10 year card received! Yay!

Naturalization

01-12-10 - Mailed application

01-20-10 - NOA

First of all, congratulations!! :dance::dance:

Secondly, don't believe the SSA when they try to tell you about immigration requirements. She does not need to go through K-3 processing.

Thirdly, she cannot get a card in her maiden name, because that is no longer her name!!

Here's what you need to do.

1. Apply for AOS (I-485) and an EAD card (I-765). Make sure you use your wife's married name on the applications.

2. The EAD will take about 3 months to come through, during which time you will be requested to attend an ASC to get biometrics done.

3. Once you have the EAD card, go back to the social security office and request a card in her married name.

That's all you need to do.

I just did this on Tuesday.

Went and changed my SSN to my married name.

I had to show them my certified marriage cert, EAD card, and passport.

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.
