Any lawyer that you hire isn't going to do anything to "deport" him, but rather probably just charge you a boat load full of money for nothing.

Like you said, it is best to move on and don't let this loser take up any more of your time or concerns.

You gave him an I-134 to take to the K1 interview probably, right? That has no legal effect on you now. You did not ever submit an I-864 because you never married him or filed to adjust status, so you have no financial obligation of any sort towards him or because of him.

Just do as others have suggested and make sure your credit is protected.

Thank you for all your responses. I actually did give him an affidavit of support form before we broke up because we were planning to go through the interview. Once we broke up, he must have kept the affidavit and took it with him to the interview. I understand that now I am not responsible for him financially because he has overstayed his visa (he arrived in the US sometime around May of 2013 and is still living in the country). Even though I am not currently responsible, I was technically responsible during the time he was here, ever though I did not know it. I am very upset by this.

I am trying to figure out if getting a lawyer would even help at all? I mean, what could a lawyer really do? I have thought about hiring a private investigator to find out where he lives and if he is working illegally, which I presume he is, so that I could file those reports with ice.gov. However, after some long and tiring phone conversations with ice.gov, they gave me the honest truth about the situation. They told me that even if I could give them that address to where he lives or works, it would take anywhere from 8 months to a year to open the file and actually go to this place of residence or work to deport him. In that time he will surely move or change places of work. So even if I do find out all the details of his stay in the US, and even the name of the select America who has housed him and helped him financially (who I was able to find out), ice.gov would not be able to even think about helping for another 8 months. I have thought about hiring a lawyer to prosecute the American women who is now currently in a relationship with this guy, because she is harboring an illegal immigrant. I have tried to reach out to her and have only had my emails and facebook messages blocked, as neither of them want me to know what they are. I am going to look into how to secure my personal information from being used, as I strongly believe that it is only a matter of time until he uses it somehow, either for a credit card or to access my bank accounts somehow.

I want to put this situation behind me and forget about it so that I can move on with my life. I have a lot of family and friend pressures that are encouraging me to hire a lawyer and deport him, but I just can't see any way that is promising!

I'm not judging, but it almost seems like your sole purpose is having him deported because the relationship ended. Nothing he does has an effect on you, and you should let it go. You've already done your part by letting USCIS know that you were no longer sponsoring him. He is an illegal immigrant and that's that. Move on.

I discovered that he has married another American...?? How is this even possible. Do counties not even check legal documents??!?! He has overstayed illegally now for 18 months... I am still looking into lawyers, but it seems that most think that there is nothing that can be done. Additionally, his brother had a tourist visa, and is now living with him and planning to overstay his visa and live illegally. I have received this information from friends who still had access to his social media sites. HELP!!

is possible to file a case into USCIS, at your local office.

steps:

1. get an infopass appointment at https://infopass.uscis.gov

2. whilst waiting for the appointment date, prep a casefile, giving as much written detail as you can, and as much printed evidence that you can - example -

on 4 February I learned that he married another USCitizen on 11 January, see attachment #11 / [then attachment #11 would be a photocopy of the marriage certificate]

3. when at USCIS local office for the infopass appointment, as the shift supervisor on the floor to let the FDNS officer know you need to speak with him/her. be firm, polite, and keep insisting only to speak with the FDNS officer.

4. go over the case that you've prepped, with the FDNS officer. If he feels you have enough evidence of fraud [fraudulent entry into the USA] then a further investigation will be started.

5. if the investigation proves up the fraud, an entry will be made in his A-File.

6. If he goes through any immigration control point he will be detained by CBP, or if he is arrested locally the cops will see the 'HOLD FOR ICE' flag in his online arrest thingie...

and that's about all you can do. is rare ICE will go seek him out at home or work, based on this type of fraud, but at the stuff listed in 6, he'll be detained, at a minimum, for some time. most likely released, awaiting an Immigration Court hearing date, as well, so keep that in mind.

Just a bit more complicated than it would be as he entered on a K1.

With compotent legal guidance he has options.

When a person enter to usa on k1, and no marry tge person who is in the visa, he cant adjust status.

Remember that on the k1 visa is the name of his fiance and if he entered with a k1 he cant adjust status with other woman.

Your name is on his visa k1.

So he cant adjust status with other woman.

Look on internet example for k1, the name of the fiance is on the visa, if he entered on k1 , he cant adjust status based on marriage, because k1 is for marry the fiance who is on the visa, no other person.

Any way you can report him to uscis, but read about k1, if the person doesnt marry the fiance on tge visa , then he cant adjust status.

When he realizes he screwed up then he will try Vawa, but he won't be able to have a Vawa case approved either,since Vawa Unit will not consider his marriage valid for immigration purposes.

Are you certain that it was a k1 visa and not a visitors visa that he ended up entering on?

Read the post from the biging, she said that they end the relationship at the interview stage, and he went tovthe interview anyway.

She didnt notify the consulate, i doubt that they gave him a tourist visa with a k1 visa interview pending.
