Ok, I just happened to look at the Visa Bulletin. What does this mean for us? We have a priority date of Feb 25, 2013 for F2A, Mexico. Case is closed, just waiting for interview. Are we ok, because our PD is before 08Sept13??

Ok, I just happened to look at the Visa Bulletin. What does this mean for us? We have a priority date of Feb 25, 2013 for F2A, Mexico. Case is closed, just waiting for interview. Are we ok, because our PD is before 08Sept13??

If you are from Mexico, cutoff dates are 15-APR-12. So you need to wait till your date 25 FEB 2013 becomes current.

F2A numbers SUBJECT to per-country limit are available to applicants chargeable to all countries EXCEPT MEXICO with priority dates beginning 15APR12 and earlier than 08SEP13. (All F2A numbers provided for MEXICO are exempt from the per-country limit; there are no F2A numbers for MEXICO subject to per-country limit.)

f2a category vb for mexico retrogressed to April 2012 and the vb of sept 2013 is for the other country and not with Mexico. So I believe, since your pd is feb2013 and you're from mexico, your pd is not yet current.

If you see a paragraph above the Cut off dates table they have put specific visa availability numbers and i quote

"Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, plus any unused first preference numbers:

A. (F2A) Spouses and Children of Permanent Residents: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;"

That means that countries other than MEXICO can get 77% out of 114,200 available Visa numbers. But for Mexico, there are no fix limits for visa numbers and hence you should wait till cases before your PD are interviewed and given visa. In short you need to wait till the cut-off date becomes current for your PD.

Ok, I was freaking out because the beneficiary turns 21 begining of April. But after posting this, I read that his age is locked in from the date that we submitted the DS-250 (December 13, age 20). Is that correct? I don't have to worry about him aging out at this point?

Reading more about CSPA and retrogress. Here is all the info.

Mexico

DOB 4/12/93

PD 2/25/13

Approval 8/30/13

DS-260 submitted 12/15/13

NVC case closed 3/12/14

12/14/13, visa bulletin for December 13 PD was 01SEP13.

So if his age locks in by the ds-260, he would be 20 (forever?? What if it take 2 years for PD to become current?). If this is correct, my other question is do we have to wait for the PD to become current again before his interview will be scheduled?
