Hello, I'm not really new here as I posted a topic back in December when we were upside down trying to figure out what to do. I never made an introduction here. My now wife was pregnant, we thought we were going to move to the states immediately and got married in the states to expedite an I130 process. Well, 3 months later, I've received a family Visa for France, baby is being born in France in May and we plan to stay for the immediate future. Boy how life is what happens when you were making other plans. We are very happy and you know, France isn't so bad

What I'm trying to dig up now is if my wife can visit the states on a typical tourist visa. We were married in Florida, have had our marriage transcribed into a "Family" document in France, and I have a 1 year family visa that started Feb 22nd. We are not filing any I130 forms, our status is she will remain a French citizen, I will remain an American citizen on a family visa and we will decide in the future if we will live in France or USA. We will get the baby a US passport for 'born abroad" once he/she (surprising ourselves) comes. So, does anyone know if my wife can visit the states on a tourist visa given our current status?

She can visit under the visa waiver program -- no need for a visa. She should carry documents showing strong ties to France at the point of entry to the US.
