Hi VJ,

Does anyone have a definitive answer if a Mexican citizen can obtain a police clearance or police records?

If so, what is the process?

I appreciate everyone who contributes to the knowledge in this forum.

Where is this Mexican Citizen lives now? Is this person in Mexico or in other country (and has lived there for more than 6 months)?

I'm from Indonesia (the beneficiary), and my husband is a USC.

USCIS

06/04/2011: Got married in Surabaya, Indonesia

03/10/2013: (Some time at these dates) Filed I-130 through a lawyer

03/25/2013: Priority date, NOA1

11/08/2013: Case was transferred to Texas Service Center

11/16/2013: Case update: "was transferred and is now being processed at a USCIS office."

11/25/2013: NOA2. Post Decision Activity: APPROVED (by Texas Service Center)

12/05/2013: Received NOA2 in the mail.

12/19/2013: "Shipped this approved or re-affirmed case to the Department of State for visa processing."

NVC

01/03/2014: NVC received our case work.

03/26/2014: Called NVC and they said that there's an error on the affidavit support and they didn't get copy of my passport. This case, I blame our lawyer.

All I know it is required for adjustment of status, wife and stepdaughter had to chase around to get these two pieces of paper stating they have no criminal record. Was in Spanish, had to be translated, even though the USCIS has a Spanish speaking line.

This page from the US Dept of State, says that "Police Records" are not available for Mexico.

Can anyone who has gone through the I-130 Process from Mexico confirm that?

They say they are not available, but people get them. When they updated the instructions for getting a K-1 in Juarez, they added police certificates to the requirements checklist. So, I do not know if they for sure are requiring them for everyone now or not. I just advise you attempt to get one to be on the safe side. Search for Carta/Certificado de No Antecedentes Penales. That is what you need. Some have managed to get them from the police station, some from the ministry of safety and some from city hall. Here is one post about it that may help > http://www.visajourney.com/forums/topic/469401-obtaining-police-certificate-for-mexican-beneficiary/?hl=%2Bcarta+%2Bantecedentes+%2Bpenales#entry6691253
