Will be stationed in Germany for 4 years. Adjustment of Status and Removal of Condition help?

Hi guys.

I entered US under k1 visa last march 2. My husband and I got married last march 7. We were about to send our adjutment of status next month. There is this one thing that we're looking into. He got his order that he will be stationed at Germany for 4 years. We're about to leave December of this year. Any advices would help regarding adjustment of status and removal if conditions. Thank you.

Is there any expedite procedures for us? Thankd in advance.

Hello, So You will have to AOS and there are no removal conditions right now, thats what you will do before your gc will expire.Since you re married only one year you ll get 2year old GC if I am correct. Also i think your medical is expired since its over a year. But it depends where your husband is stationed, over here we have doctor that does medical exam and spouses dont have to pay for it. Send with the package your husbands orders so they know he is military and will proces it faster. I sent my application in November and I have interview next week and I had rfe so it was pretty quick. I dont know if they will expedite it since its 6 months before you and your husband are leaving for Germany. Also on post over here we have immigration officer once a weak that helps military with preparing everything so its might worth looking if where your husband is stationed is immigration officer on post. Hi teanet. Thank u for the response. Actually my medical is not yet expired since i just got it last january 28, 2014. Regarding the medical, do i have to have i-693 form even though my medical is not yet expired? We are right now at El Paso, Texas. I dont know if they havr immigration officer that could help us. Do u have any idea if I can remove my conditions while in germany? We will be stationed there for 4years. Thanks. :)

Thats funny, I am in El paso also. And yes you ll be able to remove conditions in Germany, US posts are considered US soil.


sorry i understood that you got married in march 2013 so I thought it was over year ago. I dont know how it works witk K1 medical, but you might have to have just one form that you have all vacinations. But on Fort bliss is doctor that does immigration for free so you will be able to get all shots as needed.

Oh wow. Where exactly in el paso? We're here at Dyer St.. thanks for the info. We might as well contact the doctor. Di you have any contact details of that doctor? I do have a sheet of paper from my medical that states all the vacination shots I got. Its DS-3025. I'm wondering if we can use that instead of transcribing it to I-693 form.

Vaccination records is the only medical needed in AOS right?

I live off Sean haggerty so close to you. I think that DS form is enough but i am not really sure because I had to do new medical. I dont have the info, but i can look into some papers where it might be. In case you wanna talk more send me please message here on visajourney :)

if you get your green card before you leave, no issues. Once you have the hard copy orders you can ask for an expedite for adjustment of status. You can apply to remove conditions of your green card while stationed overseas. My wife got her 10 year green card while here in Italy. We didn't have an interview for it. they just approved it.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

If you can get your AOS done Before you head to Germany, as soon as you get your orders for Grmany, you can apply for naturalization (if that's what you want to do) and you get to skip the ROC Removal of Conditions altogether. It will go crazy fast.. From K1 to Citizenship in just about 2 years. The AOS process was the longest for us, but I've heard they have caught up a little there.

From K1 submission to US Citizenship- 2 years, 1 month and 2 days!

K-1 Process
• 6 MAR 2012 - I-129F packet sent via FedEx overnight •

• 7 MAR 2012 - Packet received Dallas, Texas
• 12 MAR 2012 - NOA1 (Notice by Email: routed to the CSC)
• 15 MAR 2012 - NOA1 (received Official Receipt Notice (Form I-797))
• 12 JUN 2012 - NOA2 (Notice by text message and Email)
• 23 MAR 2012 - NVC received/forwarded approved I-129F
• 25 April 2012 - Interview and Visa Approved!
• 27 APR 2012 - Collected Visa at Embassy
• 29 MAY 2012 - Arrival in US after two weeks holiday together!
*It took 46 days from NOA1 to Visa pick-up and we received our NOA2 two weeks AFTER her arrival in States!

AOS Process
• 13 JUL 2012 - I-485 packet received at USCIS
• 23 JUL 2012 - NOA I-797C received for I-485 and I-765 (we didn't do an AP)
• 10 AUG 2012 - RFE for Proof of Employment and Fed. Poverty Level/Support Requirement!(Active Duty Military but deployed last year with little taxable income to report)

• 02 FEB 2014 - walk-in Bio appointment

You have to have your AOS complete and orders for OCONUS, but check my past posts and look-up 319(b). We are headed to the naturalization interview today!

From K1 submission to US Citizenship- 2 years, 1 month and 2 days!

K-1 Process
• 6 MAR 2012 - I-129F packet sent via FedEx overnight •

one thing to note with getting naturalization that way you need to complete it in the US. To do it from overseas, your wife needs to be a green card holder for 3 years. It's not an issue if she is able to go back to the states and complete the naturalization there though.

Has anyone mentioned that for naturalization you can't be out of the country for a certain period of time? I think its not more than 6 months? or does that not apply to spouses?

If the spouse is command sponsored (on the orders) to the overseas base, the time they are overseas does not count against you. As long as you are command sponsored you are considered to be on US soil.
