Hello, I am new to the forum. I have a question in reference to the affidavit of support. I file the I129F for my fiance in January and it has yet to be approved. He has a daughter in Jamaica that he would also like to bring over with him. However, my income is only enough for him. With her we would be a 4 person household. I am currently working on my Masters and have two full time internships to complete from May to Dec. This means I cannot work for the most part. I have a PRN job that does not pay much. I have a house, but I owe more on it than its worth. I have money in the bank, but its from student loans. I was told by a USCIS customer service line employee yesterday that child support can not be factored in to my income. In addition, to this this my fiancee is having a hard time finding co-sponsors to assist us. What are our options? Any insight anyone can give will be greatly appreciated. I will be able to work fine after my internships, but thats after Dec 12th when I graduate.

Its YOU, the petitioner & USC, that needs to find a co-sponsor. Not the beneficiary. Do you have a family member or close friend that could help? Back when I applied I used my fiancé's (now husband) mother - we had no problems. I am pretty sure co-sponsors must be American Citizens.

If you can not find a Joint Sponsor for the daughter, then she will remain in Jamaica. There is no way around this.

Your post is a bit confusing. Who is the USC petitioner? Does the USC petitioner also have a child and receives child support? The USC petitioner is the one that needs to submit the I-134 affidavit of support, and if they did not meet the requirement, they are the one that needs to find a co-sponsor.

For the affidavit of support, you can include child support income. You must provide a copy of the court order showing the amount, and on top of that provide bank statements showing the direct deposit amount you actually receive from it each month. It will also depend on the age of your child and how much longer you will be receiving the child support payments. If they will end soon, then they may not be taken into account. The CO will look at the totality of your case and they will have sole discretion over whether or not they believe the intending immigrant(s) will become a public charge or not once in the US.

My fiance has relatives in the US who are citizens. Who can't be co sponsors for various reasons.

You guys are off your rocker. You absolutely have to include the daughter and file respective k2. They will be interested in your annual income above 125% poverty level for all of you. In this case, it would be in your interest to consider getting married in Jamaica. In any case, you will have to find a co-sponsor that has enough income for all of you + him/herself.

I desperately want to add her. Her mother abandoned her with her paternal grandmother and does not visit or provide for her care in anyway. My fiance has been on a search with family and friends to see if any of them can assist him. I don't want her to stay, but if we don't get the co-sponsor she will have to stay.

Let me warn you that the US embassy will put your file in a permanently “burned” grouping if you so much as even mention this notion. Maybe she will in “reality” have to stay since you cannot afford to bring her to the US. However, as far as the law, on paper, and the US embassy are concerned you cannot petition a foreign national without also petitioning for all their minor children that are dependent on them with a k2. It is a requirement (see: LIFE act). Again, failing to mention the child is considered concealing a material fact which is Felony perjury. I would advise you to either earn more income, delay until your finances are stable, or find a sponsor with considerable assets or a annual income above 40k.

I can understand your desire to bring the child. Absolutely as the child to the petition just be prepared to prove that the child was abandoned. In most cases if a child is leaving the country documented parental consent is needed. All the best.
