Thanks for proving me wrong good job....

Anyway i explained earlier she was unable to get time off of school and any time off was shortened due to the conditions in her country. She JUST finished her medical school literally a week ago and it is the first time in 5 years she's finding time off. We applied in Dec to correlate our wedding later in the year considering it takes a year to get through the process, but if it takes longer or is denied so be it. I will wait/reapply or find other means at that point.

I will admit I haven't read all of this topic, but didn't someone post that one of the only 2 times s/he'd seen a successful waiver of meeting in person it was exactly your situation?

IE: the petitioner (in your case, your fiance in Florida) was bedridden and unable to travel.

Seems like you could definitely apply for a waiver. Go for it and good luck!

I was also momentarily worried that you wouldn't be able to marry if Florida didn't allow first cousin marriage. But it turns out it does so you're ok there.

He is stating that her country does not have peritoneal dialysis facilities. I found one to prove him wrong.

Not saying that he should go to Pakistan in his conditions.

But how about Canada then? Canada is third world country too?

Answers have been given, possibilities have been brought up. Arguing to prove a point seems pretty trivial and somewhat condescending. These are intelligent people. They know the limits of what they can handle based on his medical condition. I am sure they will succeed in doing what needs to be done. If we had known that the doctor discouraged my mother from traveling to England to see her new grandson with her chronic kidney condition, we would have tried to prevent her. As a result, she died six days into her trip there. When you have a serious condition, you will sensibly err on the side of caution.

We tried and they denied her, and asked why I didn't apply for K1 visa, so thats what I'm doing, as i said multiple times, we sought every avenue. Plain and simple.

Go to Canada. Have her take a course at a local university. You haven't exhausted all options. If you want the waiver approved, then, you need to show that you have.

Meeting is a requirement for the K-1.

Even if you get this waiver approved (which, seeing now that you can work and study, I don't see it happening, it's not as bad as everyone here thought it was), you're going through a very difficult consulate.

Thats why we went right for the K1 visa. I know visiting is a requirement, unless a waiver is submitted which it is. Traveling with dialysis is always a risk outside the states.


All we can do is wait, if they deny it then we will have to figure out a way to make it work.

No. Meeting is a requirement. Submitting a waiver request does not mean you will get it approved. As you are well enough to work, and go to school, you can expect the waiver to be refused. And once it is, you need to meet, and then refile.

No you have not exhausted every avenue.. You could have met in a third country. The person that told you to go ahead and apply for a K1 was mistaken. Gravely mistaken.

And the petitioner can get up there and meet her, taking lots of snaps of the two of them together, enjoying poutine and really weak beer.

And the petitioner can get up there and meet her, taking lots of snaps of the two of them together, enjoying poutine and really weak beer.

Canada is a part of North America. I am sure these people don't drink alcohol, even Molson Canadian, and poutine sounds about as good as its name. Also, from what I understand, Canada considers what U.S. visas foreigners have applied for in the past.
