well, hardship on the beneficiary is one thing, but

if you showed actual hardship on the petitioner, IMO, you'd get some grease at USCIS.

You might, Although given recent information on how actually unwell the petitioner actually is, it will be difficult to get much traction from that standpoint.

The first line was sarcasm... my waiver is due to the fact that her country does not have peritoneal dialysis facilities and i need aseptic conditions in order to perform peritoneal dialysis. The trip itself is 40+ hours and any hiccup in the trip (lost supplies, miscommunications with the dialysis provider) could be detrimental to my overall health and not worth the risk. I get daily dialysis here, and don't have tubes and needles apparent all over my body for people to see. Thats what i meant by I do not appear sick.

And as for feeling attacked, we had thought about all the possible issues prior to applying and responded to them as needed. Cdneh you are absolutely right, USCIS does have a rigid structure which we followed and hopefully they will see our situation and see that we went through all possible avenues before applying for a waiver. I am having a 'three cornered fit' because of people saying that my fiancé is here as a caretaker, or needs me to come to the US and work. She does not need me to come to the US and work, nor do i need her as a caretaker. We thought of all of the possibilities of what could happen with the fiancé visa in our case, and made sure to address them when we applied, and will address them when the interview arrives.

Why is it, can anyone tell me, that new people come on VJ, ask questions, get answers that are honest, and right on the money, and then have a three cornered fit because the truth of the situation does not match what they imagine will happen, what they want to have happen. If they responses they get don't jive with what they want to hear, they are being attacked.

USCIS has fairly rigid criteria. You have to be free to marry, and you have to have met with the previous 2 years. USCIS don't give a fiddlers about your hopes, your plans, how clever you are, your paid for wedding arrangements, or any of the innumerable excuses people have claimed are impediments by way of an excuse. They want what they want, the way they want it, and that is the way it is.

I am also tired of the crying that goes on here, by both the original poster and the responders. The sugar coating of the responses makes me sick. Let's just get real. I have heard there is some sort of waiver for the 2 year meeting but "I personally" am unaware of anyone as yet that has ever gotten to the US without the meeting... While there may be lets be honest with the person asking the question. Let's not give them all this pie in the sky rubbish. You are right, USCIS could give a rats a** what anyones dreams or hopes are. Let's get real, shall we? And moments ago the person that is so ill just said 99.9% of people would never know he was sick. He says he works and functions like anyone else. While I am sure he is very ill will and I feel very sorry for the two of them it is irrelevant. It all comes down to what the government believes.

I think you will find people's response to her along the lines of her being a caretaker were based of the picture she initially painted, of her fiance as housebound, gravely ill.

You don't have to travel to India, Canada has perfectly aseptic conditions, and she may find it easier to attain a visa to visit you there.

It's all pretty moot at this stage any rate, you have applied and now you wait. If you are denied, bear the Canada, or other 1st world countries as a place to meet in mind.

I can explain it to you. But I can't understand it for you.

You might try contacting this lawyer, Laurel Scott. She is mentioned frequently on Visa Journey. I believe this is her website: http://www.scottimmigration.net/. Right now, it does seem to be a matter of just waiting to see what happens with your petition. I feel for your predicament. Both my parents had kidney diseases, were on peritoneal dialysis, and though my father got a kidney from his sister, my mother's transplant was not successful. I also have my Dad's kidney disease. Wish you all the best!

I am sorry, but so what? Not sure he should ever need to consider traveling all the way to Pakistan, when there are other options. Having seen passengers on my trips from Morocco coming from that part of the world, they have been traveling for more than 30 hours. Certainly not something any kidney patient should be doing. Just because it is possible doesn't make it reasonable.

Not in the same city its very far way from her city and it it through nova sans, i would need to change suppliers and doctors, stuff with insurance. Its not as simple as picking a hospital and going there, it is a very costly procedure. Believe me I've tried looking at options, if it is denied it is not the end of my visa journey, i will find a way to marry her. And Golden Gate, I will look into this lawyer and see what she says. I know you know what kidney disease entails and what i mean by looking healthy despite being sick.

He is stating that her country does not have peritoneal dialysis facilities. I found one to prove him wrong.

Not saying that he should go to Pakistan in his conditions.

But how about Canada then? Canada is third world country too?
