Is the I-765 Employment Authorization Document) the chicken or the egg?

By this I mean, do you have to have a job offer before you can apply for authorization to accept a job?

Or can you get authorization and then look for a job?

You do not need a job offer to apply for work authorisation. You just send i-765 together with your aos paperwork and wait 2-3 months for the card. Meanwhile you are free to look and apply for the jobs, even go to interviews and if you get a job offer and it's before you got EAD you can try and expedite your request based on that job offer.

You need the work authorization, either the EAD or the GC, to be able to legally work.

You can apply for any job anytime, you just can't begin that work until you one of the above.

i say crack all the eggs, throw into a wok,

then shift out and cook the chicken bits

as

the EAD app , when filed with the AOS set, is free to chase after, the EAD fee is waived.

if you chased after a SSN, you'll see 'valid only with DHS authorization' printed on it, if issued during the I-94 duration, and

the EAD is a printed DHS authorization.

so, what yer thinking, is off (but cookable) ,

as she has to be able to meet the doc requirements in the I-9 form, firstly, before working.

Still, she can LOOK FOR WORK prior to EAD in hand, so that's a plus.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

You can apply for an EAD after applying for your AOS. No job offer is required. There is no fee because it is waived when filed with AOS.

You *can* apply for an EAD before applying for AOS, but before your I-94 expires, although not recommended. Here you would need to pay the fee, and the EAD would expire with your I-94.
