I think the concern would be that he (based on what I've read) knowingly indicated that he was born in the Dominican Republic when in fact he was born in Venezuela. The reason that the CO may have indicated that they now don't believe that the relationship is valid is because to them, it looks like he has knowingly lied about something as significant as his birth, so why wouldn't he knowingly lie about the validity of the relationship.

Now, that may not be reality, but it may be how the consulate views it. Did he indicate on the application that he was born in Venezuela or DR? If he put Venezuela on the application, that's a good thing, because there's less a change of a misrepresentation charge at the end of all this.

Do what you can to obtain the birth certificate. Is there a Venezuelan consulate wherever your husband is? Usually you can try to obtain vital records from the consulate offices themselves for foreigners living abroad. That's another possibility. Then document everything you've done so that if there's a change that you can't obtain the BC, you can provide a timeline of everything you have done in good faith to get it.

Should I email the embassy at all?

I am from Venezuela and everything here is complicated:

To get your birth Certificate it takes time, to get your Venezuelan I.D also takes a lot of time.

You should contact the embassy just in case and plant them your situation. and if that doesnt help then he would have to go to Venezuela himself, and go to the Registro Principal to get his Birth certificate.

Not to seem judgemental, but if you have a DR birth certificate, why on earth would you even mention that you were born in Venezuela? His roots is in DR, not Venezuela, so he should not have even mentioned it to them. You cannot be born in two places. Sorry though but this will probably cost you a lot of money. Get a very good immigration lawyer and pray. Also why don't you guys just get married and file as husband and wife.

why on earth would you even mention that you were born in Venezuela? His roots is in DR, not Venezuela, so he should not have even mentioned it to them.

They have to be honest during the process.

It's horrible advice to tell them not to mention it to the US Embassy.

Why would you advise then to lie?

Ok so my fiance went to his second interview today. Here is what happened.. and a summary of his situation.

1.) He was born in Venezuela but his mother and father are both Dominican Republic citizens. His mother brought him back to the DR when he was 1 years old. She then proceeded to get him a DR birth certificate etc which he has a cedula and passport under. This is also the name etc he applied for visa and used up until now. 2.) He has never been to venezuela..etc.

The embassy said that he was from venezuela and he admitted it. and they asked him to write a summary and sign the paper saying that. He did. THen they said they don't know if the relationship is real at all now. They also told him to go and get his venezuela birth certificate and they will see what they can do. They also gave him back his passport.

I know this is bad so please remain as much as possible from the exaggerated "just how bad it is" comments..

should he even bother going back with his venezuela birth certificate? He said its in bad shape by the way and needs to get a new one from venezuela but has been unsuccessful in getting a new one from there.

What I need is advice.. any idea of how to fix it or a good recommendation for a good immigration attorney (not a quack).

1 & 2: If he was born in Venezuela he has been to Venezuela. I wonder why DR would give him a birth certificate if he was not born in DR? That in itself appears to be fraud. I can see where your problem appears to be. The embassy is going to have a very difficult time believing your stories now. One very serious question: Are you sending him money?

I think the man interviewing him just said that because he was intimidating him. That is what the lawyer just told me. They told him to bring his Venezuela birth certificate now. He thought the man was just saying that but the lawyer thinks it may actually help him. He says his parents have the original birth certificate but it is in very bad shape. They have tried to get a birth certificate from Venezuela before and have not had any luck.

Yes her and his father went to a place and filed for the dr birth certificate when he was one saying that he was born in the DR and he has had to deal with it now. Wasn't his mistake it was theirs!!

This problem is way too deep for me to handle. He has a FAKE birth certificate. Due to his fake birth certificate he also has a FAKE PASSPORT, and what else? His entire life is a lie. He will have to start in Venezuela and he will have to prove he was born there. How is he gonna prove that? They are going to say he's a liar because he was born in DR. You are screwed...you need probably three attorneys, one in Venezuela, one in Dr and one in US. Be prepared to spend a ton of money and there are no guarantees that he will ever be allowed into the US. I hate to sound so negative but put yourself into the shoes of the CO and what would you think? Fraud is the first word that comes to mind. No wonder they are not sure about your relationship. If you are supporting this guy you better take a few steps back and talk to some close frineds and ask them to look at this picture and see if you are being taken advantage of. I hope you are not but we have seen many people in love on here get screwed. Just make sure you know what is going on. Good luck and God Bless

Obviously this problem is too deep for you to handle if you feel that it is necessary to be so rude and negative.This is someone's life and happiness we are talking about. You should be more considerate. These people probably want to be together as desperately as the next. When you throw such negative responses out like that.. it can be devastating to read for the person who is actually going through the situation.. You make the whole situation sound Earth shattering. HIS ENTIRE LIFE IS A LIE. YOU ARE SCREWED... and then you end it with God Bless lol So hey.. What Would Jesus Do? For starters.. I tell you what he'd do, he'd calm the heck down there D&Z.

My response to this post is.. look.. you made a mistake. It is a little complicated for you to get a direct answer on this type of forum. I think you should do exactly what the consolute asked you to do and go from there. If at the point it gets complicated.. you need lawyers etc.. Then go for it. But it isn't the end of the world. Where there is a will there is a way.. You just have to be willing to put in the work. And even though most of us haven't heard much about this type of scenario... I'm sure it isn't the first time the consulate has come across it. Hope for the best but expect the worst my friend. Just do what they ask and hopefully it all works out. GOOD LUCK.

It is not clear what it says on the DR Birth Certificate. Maybe it says he was born in Venezuela? Maybe he just needs to get one original BC from Venezuela? My son was born in a foreign country, has his original BC issued there. But he also has Lithuanian BC (as where he lives now) where it is being stated that he was born abroad. No big deal and it is true.

OP: what is exactly written in his BC? Is it written that he was born in Venezuela or in DR? It is a big difference.
