Traveling to US, WVP with GHB charge

Hi,

I was wondering if anyone can help me on this situation.

My Brother from the UK (UK citizen) would like to visit me (UK citizen permanent US resident) in the US.

He got charged with GBH in the UK almost 2 years ago. He was charged and given 2 years suspended sentence, which is due to be up in a months time.

Can he still visit me easily? obviously the UK is under the VWP does he need to be approved for an additional visa? Would get rejected at US customs?

Should he wait till the suspended sentence is done?

Timeline

I don't think he can travel with the VWP, due to the serious nature of his crime, he will need to apply for a tourist visa. Its one of the B visas not sure exactly which. Follow the guide on here.

He would apply for ESTA, which asks him about his criminal history, he says yes and it would be rejected.

He needs to apply for a B2 and a waiver. Might want to give it a few more years with his conviction being so recent.

Hi,

He will not qualify for VWP as a result. Once his sentence is up he can apply for a visitor visa at the US consulate.

If the possible jail time exceeds one year for whatever crime was committed, then he may well be ineligible for having committed a Crime Involving Moral Turpitude (CIMT), for which he would need a waiver, one that might be nearly impossible to get given the recent nature of his crime (GHB?).

Grievous bodily harm (often abbreviated to GBH) is a technical term used in English criminal law which has become synonymous with the offences that are created by sections 18 and 20 of the Offences against the Person Act 1861.

The distinction between these two sections is the requirement of specific intent for section 18.

The offence under section 18 is variously referred to as "wounding with intent" or "causing grievous bodily harm with intent".[1] The words "with intent" refer to the specific intent required for this offence.

The offence under section 20 is variously referred to as "unlawful wounding",[2] "malicious wounding"[3] or "inflicting grievous bodily harm".[4]
