Hello,

im a born US citizen and my husband (whom i married 3 years ago) entered in the US illegally 10 years ago. we have a american born baby girl. i petition my husband (I-130) and it got APPROVED =) MY LAWUERS SAID WE had to now submit for the hardship waiver 601A. so we submitted the documents with all its proofs etc but the USCIS sent it back rejecting stating that it was filed incorrectly, that i was missing the NVC case number. but i have no case number. NVC said that USIC sends then package to them and then they send an NVC number. can anyone please advise or tell me what should i do. i emailed nvc601A and NVCinqury about 2 weeks ago and have yet not received a responce.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

someone can correct me if i am wrong because i filed an I-601 not I-601a so the process is different however from what i have heard, first get i-130 approved, then wait for NVC to get your approved i-130 and case, they will then assign you a case no, invoice id, etc. you need to pay the invoices once they send them to you and advise them you are going to submit an I-601a, they then send you a payment confirmation of the fees and hold off on your interview scheduling until your waiver has been adjudicated. you may also want to check out the site immigrate2us.net they have tons of people that have filed these and forums, instructions, etc. for the i-601a's. Also if i read correctly that your lawyer told you to do the i-601a, they should already know when the appropriate time to submit the waiver is, doing it at the wrong time can be costly, a waste of time and can have a negaitve impact on your case. good luck
