For cash in the bank? I would do at least the last 6 months to show he has had those assets and will most likely still have them, and that they were not just recently deposited to satisfy the affidavit of support.

what if he doesnt have that much on his account all the time only byweekly when he gets paid?

Then I doubt they would accept that for assets. That is just his pay, and they already know his income, which falls slightly short.

can i send the aos with that affidavit missing that much and get the ap and eda and worry for the rfe afterwards or ill get the rfe first?

You can send it off as is, with him being the few hundred short/cash in bank account and the one bank statement and see if they send an RFE about it, which they most likely will. The thing is, sometimes they halt everything when someone gets an RFE, so the EAD/AP may not still process. However, sometimes they go ahead and process the EAD/AP anyway. Taking the chance is solely up to you.

what about 401k? he has 3k in it

Yes. List it and show proof. Stocks, bonds, savings, etc. Any of those can be used as long as they can be converted to cash within a year.

does he needs to prove his 401k can be cash it in 1 year or just proof of him having that much is enough?

Just send documentation that he has the 401k and how much is it is worth. They may or may not accept it. You might as well try. If you get an RFE though, you will need to provide proof of enough income and/or assets from yourself, your current joint sponsor, or find a new joint sponsor that does meet the requirement. Otherwise, your AOS will be denied.

part 6 my total reported federal tax return. income should i put what he made alone or jointly with his wife?

Jointly, whatever the number is for Total Income, which is line 22 of the 1040. Even using an IRS transcript, have him send a copy of his most recent W-2 to show his individual income.
