They put divers in the water, and were unable to identify any other occupants of the vehicle (NB: they were checking multiple vehicles in a flooded river).

Apparently I missed that. My bad! Regardless, they probably did the best they could. Personally, I would be grateful that my life was saved.

Well, he's at least hired an attorney (Ed Ferszt, whoever the hell that is) who has filed pre-lawsuit paperwork (IANAL, but it goes further than just thinking about it).

He filed a claim form with the county, which is indeed a step further than contemplation of filing an action. It's very possible that in order to file a claim with his insurance company, he has to have a pending action or taken a step preserving his rights (which is what the claim form does).
