Nice to have an uncle with a six figure salary.

Sponsoring 18 people? girlwerewolf2xn.gif That is going to take a damn good income.

No wonder some people want to cut off chain immigration.

Good luck to you OP. I hope the Bangladesh embassy isn't picky about family cultural considerations if the marriage is going to be against the will of both families. That might be something you want to look into before you hatch this plan.

Assalamwalikum & Namaste.

Hi,

I have a really complex query.

Let me put it forward as simply as i can.

My uncle (my dad's brother), went to USA through DV Lottery.

Then after a while, he applied for his siblings, (3 brothers and 1 sister)

It happens that they are all married, and have children, making a head count boom to a staggering 18 people in total.

Now it has been almost a decade now since he applied.

And the last update confirmed that we will probably have to apply for the visa next year.

Thanks to Almighty.

However,

Here is my issue.

I have a lover, and i am very serious about her.

I wonder what to do.

I want to bring her to USA as well.

But my family is very conservative about premarital relationships.

In other words, i want to bring her to USA without their consent.

Now,

I can afford the expenses.

I am a EEE graduate, and working in a Bank in the IT department.

So i also have a decent job experience,

I believe i can provide for her once she is here.

Now that you understand my predicament.

I need to know.

1. Right after i will land in USA, what is my status, am i a citizen or a permanent resident?

2. When can i apply for my girl friend, and which visa procedures do i have to follow?

3. If there is no such procedure, can i come back to Bangladesh, marry her, get a marriage certificate to prove the validity of marriage,

and then once i return to USA, then can i apply for a visa to bring her to USA?

4. How long will this procedure take?

5. What will be the expenses involved?

Please Help!!! I am in need of your advice. Thank you.

You do not need to be a US citizen to petition her. There seems to be some confusion about 5 years for citizenship and 2.5 years to bring her.

Here is the straight dope.

1. You are a legal permanent resident (LPR) when you enter the US on your immigrant visa. (You can choose to apply for US citizenship after having a green card for 5 years.)

2. AN LPR cannot file for a girlfriend or fiancée. You can not file anything for her.

3. This is the most popular path. Immigrate to the US as single as a derivative child. Get green card. Return home to marry. File as an LPR for a spouse. So, after immigrating to the US and getting your green card, it's a good idea to go back to Bangladesh to marry her. Your Bangladeshi marriage certificate is what you will need to petition for your wife.

4. 2-3 years after you file. You file as an LPR. You do not need to wait for US citizenship.

5. Look at the Guides. There is a good sample of the usual fees. There will be additional expenses for the medical, local documents, etc. Expect to spend between $2,000 to $5,000 for all costs.

Yes, this is the reason immigration wants to do away with the sibling category. Makes sense, 18 people and counting from one DV lottery winner. That's staggering.

By "immigration" wanting this - who do you mean?

No US agency or department can "do away with the sibling category." And none have advocated for this proposal.

Just a piece of it. Here's the whole blurb. http://www.immig-chicago.com/blog/2013/05/28/your-immigration-status/immigration-reform-the-time-to-sponsor-siblings-and-married-children-is-now/

"If BSEOIMA is enacted in its present form, U.S. citizens would no longer be able to file immigrant petitions for their siblings or married adult children over 30. Specifically, the current sibling category known as F-4 would be eliminated 18 months after the bill is signed into law. At the same time, an age cap of 31 would be placed on the F-3 category for married adult children".

So, it's merely one of many perposal in potential immigration reform.

Just want to clarify that no US agency or department has advocated for this position.

Elimination of the F3 category is all talk by a few congressmen.

Immigration reform 2013 - dead & abandoned.

Immigration reform 2014 - dead & the Republicans refuse to talk to the White House while Obama is in office.

No facts, no laws, and no proposal that will become law anytime soon that the F3 category will be eliminated.

There is also a requirement that K-1 visa entrants must adjust status within 6 months of marriage to. A good thing overall in my view, but I wonder how many are going to get burned because they didn't not plan for the $1080 fee? It wasn't specified what would happen if someone failed to apply. I doubt anyone is going to pay to deport them, but would they require self deportation then reapplying for a CR-1? Although all in all, I don't expect immigration reform to get done this year.

Immigration reform 2015? Hard to say, the voters may decide Republicans are to blame for nothing happening in congress and boot them out. Or maybe they'll decide it is all Obama's fault and give the senate over to Republicans. Although I'm expecting more stalemate between the two parties, with lots of rhetoric and nothing really accomplished.
