Can i-751 waiver (divorce) be approved if the person (applicant) cheated on wife 6 months after marriage?

... that is terrible advice ... like rewarding illegal and immoral behaviour ... my advice, write letters about this to anybody you can think of, big shots at USCIS, congressmen, senators, newspapers etc... don't let him get away with it

What is done is done and you can't change the past. You can only change the future. Don't let that episode define who you are, and move on with your life. As you grow older you will realize that no one can have that much power over you, and you will never allow anyone to control you in that manner again. Lesson learned.

Get the divorce, rid yourself of that person and get a fresh start. You have your entire life ahead of you.

We have all been there when we were 21. No shame in being naive and trusting at that age.

Your ex may or may not get a green card. I am not a lawyer much less an expert at immigration. But at this point what does it matter now? He cheated you, lied to you, possibly physically and definitely emotionally abused you. I am really glad you didn't continue a relationship with this man. People cheat and people get divorced weather they were both USC or not it doesn't matter. Its over and you can move on. Pray for peace and love and understanding. You knew from the beginning this man was not a good man when he first brought up the coming to usa on tourist and getting married. Next time pay attention to not only to "the signs" but your gut intuition. Learn from this mistake and get help/counseling to avoid getting used again not only by a foreigner but any man. Now take a step back, reflect on how lucky you are to get him out of your life so quickly and let it go.

I am asking about an I-751 Waiver based on "good-faith marriage" when there was a divorce.

My ex used me for green card and I ended the "marriage" before the 2 years. I wanted annulment, but he made threats against me, etc so I had to settle for divorce. It lasted 7 months (living as "married" couple). It hurts beyond words.

So if you or anyone you know did an I-751 Waiver with divorce, what did they ask for? Is it more evidence than joint I-751? How was the interview, long, tough, easy? Did they ask for a personal statement saying why you got divorce?

My "ex" has this evidence: 2 utility bills (phone and cable), a joint bank account (only his name added to mine, no joint activity-he had no access to it), rental lease stating that we live with my mom, photos (with family, no wedding photos because we didn't have wedding), NO Joint tax return at all, not even one as we were together less than a year.

What are the chances he will be successful in ROC?

I reported his fraud to USCIS and they put it in his file.

Still liable for that I-864, but he will have to take her to court for this. Maintaining his life style for the next ten years at 25% above the poverty level.

This can be overcome in a divorce court with a darn good attorney to demand alimony payments twice that of the 1.25 poverty rate.

So really cannot just forget and move on. Now if he were deported, would not be a problem.

He obtaining his US citizenship will be to her advantage, that is when that I-864 can be torn up, but will have to live with getting away with it.

Oh, she will still be liable for any public aid he receives with that I-864.

Not really bragging when literally by joining a singles club, thousands of women contacted me. But if you don't respond in a couple of days, they will go away and try to find another sucker.

The applicant (immigrant) is applying with I-751 Waiver due to divorce after cheating on wife. After 6 months of marriage. And they only dated for 3 months before marriage. Wouldn't this be seen as not intending to stay with the wife and establish a "good-faith" marriage? Thanks.

The ex-wife reported this to immigration.

What USCIS will look at - in theory - is whether, at the time of marriage, the applicant intended in good faith to establish a life together with the USC spouse.

What if - hypothetically - the applicant was madly in love, did all the "right things" and then came home a week after the marriage to find the USC spouse had built a shrine to Adlof Hitler in the basement?

You can't look into the soul of another, but they will look at the totality of the circumstances. Admittedly in a divorce waiver case they will hear only one side of the story. Maybe he will say that he cheated because you abused him or just plain wouldn't sleep with him, and you won't be there to contradict anything.

I rather suspect that USCIS tries to be reasonably good, and professional, and thorough in these cases. They know they are only hearing half the story.

My case is the opposite. My husband and I got married in April 2012, I got my GC in September 2012 and found out he was seeing someone else. I was devastated! We got divorced in December 2013. My question is: Do I need a letter from him stating that our marriage was bonafide? I also would like to mention that we have 2 children and my mother is a US Citizen so I had no reason to marry for the GC. Any help would be appreciated.

That is not what the I 864 says.

Back on topic, sounds like he has a reasonably good shot at getting his waiver approved.
