Catch-22 on I-134

Timeline

Question 2 on the I-134 says: I am ___ years of age and I have resided in the United States since _________ .

The problem is that I don't reside in the United States at the moment and have not for the past year. How do I answer that question? The form does not permit anything but a date. What date do I put there that makes any sense? The day I was born?

This is in fact NOT a catch-22 or trick question. The question is specifically asking in relation to your age, how long have you resided in the US. For example, if you are 30 years old and have only lived in the US since you were ten (due to immigrating)… it would be something to the effect of 30 and March 14, 1994.


If you've lived in the US all your life... it would be your birthday

To clarify my situation:

I was born in the U.S. and lived there my whole life, until 2 years ago, when I moved to China, where I am living now. I will return to the U.S. to get married and settle. Unfortunately, the form does not allow for this explanation. I think my best bet is to file an attachment with my explanation. Does that make sense?

No. you don’t want to do that. I know what they are asking for... in the first line put your chronological age (how old you are...ex: 33) then in the second line put your birthday (example: March 14, 1981). This is a question of origination... with regard to YOUR US citizenship. Do not make it unnecessarily complicated.

I had a similar situation as you as I am a US born citizen who moved to China to live and work. I filed my K1 while living in China, but returned to the US about two months ago to re-establish domicile and find work. Unless it was your intention to abandon your US citizenship and never return to the US to live, you should answer the question as if you still live in the US.

Hi, I also have the same blank spots on my I-134, I have been residing out side of the US for more than 10 years but continue to file my US taxes in the US. So I should do the same, list my current age and residing in the US since birth?

Let me put it this way…. I know a kid living in El Salvador almost all his life. He was born on February 17, 2002. His mom was deported when he was 1 month old (~3/17/02). He has ever since lived in El Salvador. For the purpose of the I-134…. He would theoretically answer: I am 12 years of age and I have resided in the United States since February 17, 2002.
