a friend of mine ...ask me to post about her situation... she had two previous denial first for a tourist visa back of 2004 but shes been refuse for lack of prove document that the co was not convinced.... and other one for a working visa back of 2008 and she has been denied for the same reason lack of supportive documents that the co was not convinced.... Now she got married with a USC and they are filing for cr-1 visa ... does previous denial will going to affect in her situation? what should she need to do?.... any advice and suggestion is really appreciated ... thank you

No. all she and her husband needs to that is to file correctly and submit necessary documents. Past denials won't affect this process at all.

February 28- AOS package sent. ( I-130, I-485, I-765)
March 5- Package delivered to USCIS Chicago.
March 11- Email and text notification with Receipt Numbers.
March 14- Hardcopy of NOA1 for all three applications.
March 21- Received biometrics appointment letter for 04/04/2014
April 2 - Completed Walk in Biometrics appointment successfully. (Original Appointment was for 4th April)
April 9- I-485 Case status has been updated to " Testing & Interview "
April 16- Text and email alert for case update for AOS interview on 22nd May 2014.
April 18- Hardcopy of Interview notice received in mail.
May 22- AOS interview, approved on the spot and got stamp in my passport.
May 27 - Approval notice of I-130 and I-485 in mail.
May 29- Received GC in mail.

ROC Timeline:

03/28/2016: I-751 package sent to CSC

03/29/2016: Package delivered.

03/31/2016: cheque cached.

04/02/2016: Received NOA1 in mail, dated 03/29/2016.

04/13/2016: Received Biometrics notice for the date of 04/25/2016.

04/21/2016: Early walk in Biometrics

09/28/2016: Text and email alert about approval of ROC

10/06/2016: Received 10-years green card in mail

thanks for your prompt reply ... yes she and her husband working out all the documents needed for her immigrant visa application.... does it need that her husband should be present during the interview? or is it ok that she can go alone as long that they have all the documents needed for her cr-1 documents...

It is NOT compulsory that he attend the interview, it is a personal choice- That said, I FEEL that it speaks volumes for both partners to be there for such an important life event.

2014-04-29 - DS-260 completed online and approved on 5/14/2014

2014-04-16 - I-864 INVOICE Generated and paid

2014-04-21 - I-864 Package sent via FedEx

2014-04-22 - I-864 Package at NVC Signed for by B Standish 9:21 am FedEx

2014-05-14- I-864 package on case approved

IV

2014-04-24 - IV INVOICE Generated and paid

2014-05-02 - IV packets sent via FedEx scanned on 05/05/2014 approved on 5/29/2014 - 24 days

2014-05-29 - Case ONE OF TWO completed, 48 days

2014-06-20- CASES(s) complete Case TWO took 71 days (checklist)

Consulate

2014-08-13- POE --FT Lauderdale, FLA for my wife

221(g) additional follow up required with Consulate

2015-06-19- POE FT Lauderdale, FLA fro my Stepdaughter

yes ... but she has this anxious feeling because of that previous denial and also it has been two years plus since they just met in person and got married right away....

The couple will need to demonstrate a bona fide relationship to the consular officer. Maybe it's time for her hubby to visit again.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
