His method of getting here will not be an issue for him.

His getting into a fake marriage for papers will be, if you have evidence. So far, your evidence doesn't look too strong, unfortunately (it's rather disorganized). Have you reported this? If so, to whom?

Entering with the intent to immigrate is not right, but it's more like a parking ticket, whereas getting into a fake marriage is like grand theft auto.

I am a bit confused on your timeline, so forgive me if I missed something. He came here on a tourist visa and "forced" you into marriage? Did he adjust status? If not, how did he go back to his country to propose to his girlfriend and then come back to the US? If he did adjust status, then did you have to sign off on that? I am only wondering because if you did have to "sign off" on his status adjustment, at what point did you decide this was fraud?

Yes he blackmailed me into marriage. Yes he got his conditional green card approved. 2 months later I realize it is fraud because he is cheating on me. Not only that, there were other subtle signs.

How could they seriously still keep him here if he committed 2 immigration frauds, not just one? First, marrying on tourist visa, then marriage fraud, and blackmail, abuse, lying to USCIS, etc...

Legally the USCIS would have to be convinced that he did commit fraud first, before they can decide on the action to take, if any at all. If you decide to step forward and file a complaint or denounce him, do so as your civic duty, and once you do it, you need to let the authorities decide on the course of action they deem appropriate. Justice [in this context] is oftentimes not fair, and seldom, if ever, swift.

I never wanted to marry him but he blackmailed me, but I also loved him so was hoping it would work.

I reported it to USCIS, I went there and spoke to a fraud officer, she put everything in his file. She said he will be questioned when he tried to remove conditions on his green card at the interview.

I know I don't have strong evidence because unfortunately I can't get a written statement out of him saying he is using me for green card. It's circumstantial.

He also told me he will give me $4000 when he gets his green card after we separated. And he also said he will take me out for a big dinner when he gets his green card because that's what he wants. He told me this after we separated and of course that is a sign that he just wanted the green card.

Also the fact that he threatened me against the annulment proves fraud too but I don't have evidence of him threatening me.

Also since he is removing conditions with I-751 Waiver, he has to prove good faith, and wiith all my reports I don't think he will..

Sounds like you reported it, so good for you. USCIS will do their own investigation. He cannot petition for his new GF for years, and when he does, he will be under a lot of scrutiny for fraud (if he somehow passes his other scrutiny).

No I don't have it in writing unfortunately.

Yes I reported everything. I don't know how USCIS can even believe a lying person who is trying to stay here over a US citizen who was taken advantage of. smh.

Are they that gullible? He shouldn't get it in my opinion since he is applying with I-751 waiver, which means higher burden of proof and this is what he has for "proof": lease stating that we lived with my mom, some photos with my family and him, bank account with only his name added to mine, 2 bills in our name, NO joint tax return.

USCs take advantage of foreign people all the time, think human trafficking, so your status as a USC does not give you more importance than someone else's in matters like this. Not that I believe him, but this is not going to win your "case."

Thanks but honestly do you think he will win and remove conditions? Will the letter from my psychologist help?

I was a victim of marriage fraud for green card. He came here on a tourist visa with the intent to marry me, a US citizen. When he came here I didn't wanna marry him cause he didn't seem like a good fit for me.

He BLACKMAILED me into marriage because he came here on a tourist visa with the INTENT to marry me as we were planning it(before he came here) BUT when he came here I changed my mind because he wasn't a very nice person, and he said IF you don't marry me like you said you would, I will report you for "conspiracy" to marry me on a visitor's visa, which is potential visa fraud. I was soo scared and I married him. I was so stupid though. But I also loved him and was hoping it would work but I def married under duress.

Of course 7 months later I realize he is using me and I tried to get annulment, he THREATENS me again and makes me get a divorce and wait additional months for it.

I know this is hard to believe that someone could be so dumb but I was only 20 and in love, didn't think straight, etc. If i were to report that he blackmailed me into marriage, could I get in trouble because of planning to and marrying on tourist visa even though I was blackmailed into marriage? And I was the victim of marriage fraud.

Secure legal counsel.

Seek annulment.

If that doesn't happen, refer back to legal counsel on what your next step should be.

She filed for Divorce, she may be divorced by now, unclear.
