hi

both, because both have to prove that they are USC or LPR, copy of an American passport proves that they are USC

she also has to send copy of marriage certificate because they have to prove the relationship between joint sponsor and household member and also she needs to send proof of living a the same address as her spouse

This is correct if their income will need to be combined.

Imagine the following two scenarios where the income required is $35,000

Scenario 1:

Petitioner earns $0

Joint Sponsor 1 earns $40,000

Spouse of Joint Sponsor 1 earns any amount

Petitioner files I-864 and it primary sponsor

Join Sponsor 1 files I-864 and is the only joint sponsor, Spouse is only included in the household count, income doesn't matter.

Scenario 2:

Petitioner earns $0

Joint Sponsor 1 earns 20,000

Spouse of Joint Sponsor 1 earns 20,000

Petitioner files I-864 and it primary sponsor

Joint Sponsor 1 files I-864, wife files I-864A so that her income can be combined to reach the target of $35,000. Both are joint sponsors.

This form is just a contract or acknowledge to the NVC that you can share the income of your uncle in the presence of his wife.

So uncle wife should sign this form to justify that " yes i give permission to my husband that he can sponsor to you"

It is same as your principal sponsor has no income but filling I-864 form

If you see I-864A form . its has 3 pages....Just fill-up it with require question and write N/A if income is zero....

Sign and date by Joint Sponsor Wife

But if they did not ask to submit passport copy , marriage certificate and same house residence prove from her then okk but i think you need to submit her passport copy at least with I864A form

I replied to this in another thread without realizing two separate cases were getting mixed together...

Your original post mentions the join sponsor having his income taxes filed as "married filing jointly." This is separate from the issue of needing both of them as sponsors. If his income is sufficient, then you'll need to submit his information, the tax return along with an and documentation of how much of the income on the tax return was his. The wife is irrelevant other than being included in the household count.

If the wife's income is required to meet the income requirement, then she would need to submit the I864A along with the passport and such as she would become a sponsor as well.

I know my joint sponsor income is above 125 % poverty level individually but his wife name is written in Tax return ..

If this is right then what information should entered in Part 6 of 6a , 6b ,6c of I-864 form ??

In that condition wife just need to sign I-864A form and nothing else ?????
