Timeline

So I was talking to one of my colleagues at work and he tells me that a friend of his is going to file for DCF (India) although he doesn't reside in India but in the US.

Is this possible? So I check the USCIS website and I find something that says yes, some US Consulates abroad allow this.

What can you guys tell me about this? I wonder why I got a k-1 and 3 yrs ago and still immigrating...

when i investigated the option, I chose against it. There is a length of residency requirement (at least in India). There are some embassies where this is not the case.

By your timeline it looks like you're in removing conditions stage. DCF isn't something you're going to be using unless you're planning to marry someone else. I'm not sure what information you are looking for...but there are some pinned topics in this forum you could look through if you just wanted some general idea.

I got a K-1 visa in Spain (European community) 3 years ago and I am happily married, so no, I am not thinking of marrying someone else.

Actually, the information is not for me (although I am curious about this DCF option since we all know that from k1 to 10 yrs. GC is a long, costly and frustrating process). The information is for some friends of mine that are planning to get married soon in India.

As I was saying in my previous posting, this colleague of mine has told me that he knows some people who don't have long periods of residence in India and they file taxes in US; they just went there, got married, stayed for 15 days, filed and done.

So, after 3 years immigrating, and after listening to my colleague, who is 100% sure of the information, I am wondering if I could have done DFC at my time and I avoided waiting periods and money spent. That was all...

I thought that DFC requires residence requirements for the US citizen living abroad, which makes sense, so I was wondering if somebody knows how these people could have done that.

Doing DCF in India is not as straight forward as your friends seem to think it is. I got married in India in August. The requirments for a DCF in India is that you have to live in India for 90 days and provide proof of residency before you can apply for DCF. In the past maybe a couple of years ago, it could be the case where you can go to India get married and file for DCF within a couple of weeks.. this is definately not the case anymore. If you goto the Delhi consulate website, you'll be able to find the current requirments for filing DCF in India.

As for DCF's in other countries, the requirments vary.

hi

i just got married in delhi and filed dcf so i have experience on ths one.

first of all you can get married in india. every place has a different rule for get MARRIED. the district you marry in will have a minimum residency rule for marriage. in Goa you only have to reside there for 2 weeks to marry. so you can go for 2 weeks and get married. however in delhi they required 1 part to live in the district for 90 days (i think). im unsure about other areas, i bey goa has the shortest residency in district to get married.

next - your married and you want to file dcf.

this is a 90 day residency requirement. do not worry about anything else. the embassy website says strictly that you ahve to register with the FRRO - its a pain in the butt and not required (i didnt have it and many others applying on same day as me did not either). additioanlly the embassy site says they require bills to show proof of living in india. well - she gave me all of mine back. she didnt keep a single bill as part of our application.

however dcf is only the first step. you then have to submit the papers for the next step in the process and wait for the interview date - this will take a minimum of a month to get. so it will take about 2 months total after the DCF file submission.

nothing can be done in 15 days!

if your friend is thinking that then they havent done any immigration in the past decade! otherwise all of us here on VJ wouldnt be so sad from being apart from our loved one.

Thanks for the info. Actually, my brother-in-law would like to get married in Bombay next year and if he can avoid the long process I have been through with my K-1, EAD, AP, AOS and Removal of Conds. much better. This information is really helpful!! (I'm kind of sad cause in Spain (where I am from, they don't even ask for residence, just physical presence of the US citizen there...but I didn't know about it))

I hope you guys don't have to wait very long.

By the way, how did you guys meet? I'm super curious.
