My Father in law (US Citizen) wants to sponsor his sister who is abroad. She is married, so her husband would need to be sponsored as well. I reviewed the information on USCIS and on the pinned threads on VJ and got the following:

1. FIL has to submit proof of his citizenship

2. FIL has to submit his Birth Cert and his sister's Birth Cert proving their relationship. if the document doesn't exist, they can submit affidavits or other documents defined in the instructions form for I130.

3. Complete I-130

4. Pay filing fee of $420

my questions

1. Does he need to file a separate I130 for his sister's husband? I don't think so because the options don't list it, but maybe i'm missing something. If not, how does this get addressed?

2. Since he is sponsoring his relative, won't he have to prove he has the financial status to support his sister and her husband? I did not see any information pertaining to this on the USCIS website. If so, where can i find this information.

Just the beginning and i'm sure i'll have more questions, but thanks in advance.

1. When a USC petitions for a sibling, the sibling's spouse is included.

2. Review the I-864. The financial requirements are not requested or needed when filing the I-130. When the sister and her husband are eligible to apply for visas (about 12 years after filing the I-130), the NVC will request the financial info from the petitioner.

Ok, so i don't have to file a separate I-130 then.

did you mean 12 months after filing the I-130 or 12 years?

You FIL is applying for an F4 visa for his sibling. You can see the dates being processed by googling visa bulletin India lists 22NOV01 for the current one. That wait time can expand or contract depending on the number of filers and changes in immigration laws over the next decade

This will not be over quickly. You will not enjoy this.
