Hi all,

I would need some help here please. I filed for my AOS in March 29th , 2013 and got a letter from the USCIS of me been waived off the interview. Till date, I haven't heard anything about my case. I called USCIS and was told they are working on cases in May.

What do I do now?

they gave me a service request number tho.

Very very worried.

Please advice me on what to do next, Thank you all

I stand for correction, but I know if one doesn't go through the AOS interview after a year and getting to 2 years the individual is given the permanent 10yr Green Card instead of the 2yr conditional Green Card. That probably might explained why USCIS says your interview has been waived.

While it is correct that applicants who have been married for over two years at the time the AOS is being approved get a ten-year-GC, the interview waiver procedure has nothing to do with this. The NBC routinely waives a certain amount of K1 entrants from the interview (it is said that there is roughly a 50-50 chance of having an interview or not). I was waived too and got my card after eight months without an interview.

To the OP, you have been waiting for a long time. If you look here on VJ, you will find that you are not the only one. There are even people from November/December 2012 who are still waiting. I suggest getting a congressman or senator involved. I know how frustrating the wait is. Good luck and all the best!

We are right there with you. It hasn't really bothered me until now because too much is going on in our lives for us to be concerned about this. It is really aggravating so I feel you. We have to get things together for the EAD/AP renewal. While we're at it, I will be sending a request to my congressman. Your service request is more than likely useless. If anything, the outcome will be some vague excuse for the delay. We had two requests. Both provided differing and conflicting information for the delays. Basically, they just sent out a response to uphold an obligation, but apparently, there is no obligation for clarity. They just want us off their backs. I might be more understanding if I actually knew what was going on. Afterall, I was quite understanding the first 12 months.

It is well.

They do not waive interviews so people will have to wait until they can get a 10 year card. As a matter of fact, someone adjusting from a K-1 is supposed to receive a conditional card no matter. There was a lawsuit that changed that to say a K-1 entrant that is married 2 years or more can receive the 10 year card, but nothing in the USC code or USCIS guidelines has been changed about that so far. Some get an interview and some do not. It seems to be random and about a 50/50 chance at being waived. The backlog at the NBC in the last year or so has made those being approved without an interview a longer wait than those being interviewed.

I just wanna know what is going on with my case cos

The National Benefits Center as at today are working AOS cases in July. while I did file way back in March 2013

Did you file the EAD and/or AP at the same time of AOS? If so, it would be time to renew. I was about to contact our congressman, but we sent the EAD/AP renewal first. No telling if it was coincidence, but our AOS was updated to card production about a week after our EAD/AP renewal was accepted. One year one day from the AOS acceptance date.

Great. Just got the same update

"On April 23, 2014, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283."

That's this mean the application is approved ?

Yeah. You will probably get another update within 24 hours of this first one stating the letter(NOA2) has been sent as well stating approval. If so, don't get confused. Your card is still being produced, and you will get updates with tracking number when the post office receives your card. Congratulations!
