Any other AWA cases waiting in AOS limbo?

Our paperwork is done, and the lawyer is sending it all off ASAP. Our case may fall under AWA depending on whether my husbands arrest triggers anything or not. He's not convicted of anything yet but the charges fall under the AWA. Our lawyer is optimistic that things will go well and we will be successful as no bar is triggered, but we will have to face a tougher time at ROC though.

I'd be interested in hearing from other AWA affected couples who are going through this?

AOS from VWP

17 March packet mailed (day 0)

21 March Priority Date (day 4)

27 March text/email NOAs received (day 10)

31 March hard copy NOAs received (day 14)

7 April Biometrics letter received for appt on April 28 (day 21)

11 April successful biometrics walk in (day 25)

29 April Testing and Interview ? (day 43)

8 May Date on NOA of interview schedule (day 52)

12 May received hard copy NOA of interview scheduled 16 June! (day 56) :dancing:

27 May email received stating EAD card is in production and my AP has been approved (day 71)

30 May email received stating EAD has been shipped, should arrive Monday! (Day 74)

2 June received EAD in the mail (day 77)

16 June INTERVIEW :dancing: APPROVED!!!! (day 91!!!!)

20 June email received stating Green Card picked up by USPS due to be delivered on Monday 23rd!!!

23 June my green card arrived :dance:

Total time from packet mailed to Green Card received 98 days!!!!

Hi,

My husband who is an American Citizen had a sexual assault conviction, a couple of years back but this is not against a minor. He has filed for an i-130 for me who is recently residing outside of the US. We dont have kids.

He got a request to do biometrics. I have read about AWA and have specifically noted that this is for conviction against minor. I am wondering if his case would fall under AWA still? What are the chances of getting this approved?

Please help! We have been waiting for almost a year already since NA01 :(

I think if you can submit all of the court documents showing the offense was not against a minor then that will help, his name was probably flagged if it was on the sex offenders registry. I've done so much reading and research about this, I have a great article I can pm you shortly. Definitely talk to a lawyer though, AWA isn't something you want to handle alone.

I just want to know what happened to your case, because right now I'm in the same situation, the victim is not a minor yet we just got a biometric appointment for my USC husband. I will be very grateful to know how your case went and what to do next.
