Getting Married in the US- Change of Visa Status Process

My boyfriend and I have been together for almost two years and are planning to get married next March/April in the US. He is currently on a J-1 Visa which expires a year from now.

Does anyone know the Visa process for his change of status? i.e. can he do a change of status on a J-1 once we're officially engaged/married? Will he have to go back to the UK for any time during the change of status? He has also been offered a more permanent position within his company, which would hopefully extend/change his current VISA.

What's our best approach in this situation?

Thank you!

I would start by reading the Guides.

Does he have a 2 Year HRR?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

If he is already in the US, once you are married he can apply for AOS. See the forms that are required in the link --> http://www.visajourney.com/content/downloads

In theory he will not need to return to his home country and should be able to stay in the US. However, some J visas carry a restriction that the holder must return home for a period of 2 years. If his visa does not carry such a restriction he should be OK, otherwise, he will need to obtain a release from the two-year clause from the organization that sponsored his visa back in the UK.

Good luck!
