When they are living in the USA and make income enough to require paying taxes.

Ok, that's great to know, Hank. Just got worried for a second when I read [more like sleep-reading from a phone after waking up blush.png] about a K-1's post that her husband is joint-filing for taxes when they only got married last Sept 2013 and she got her EAD/AP card March 2014. And now, I can't find that topic anymore.

Thank you! good.gif

Well, I came here on a K-1 Visa, got married December 2010, my husband and I filed taxes married filing jointly around February 2011 without my GC but I do have my SSN. We filed married jointly for 4 years now. And, oh, I haven't worked since I got here up until now because I have a baby to look after. LOL! I'm glad we did filed married jointly since I got here, eventhough I wasn't working because it's important to have our Tax Return Transcripts.

Well, that's the thing, Hank! laughing.gif But, we're only married late January & he already filed his 2013 taxes on the 1st week of February. Considering he was single for the whole of 2013, I can't be declared as his dependent yet, right?

Have to wait for next year in your case, December 31 is the magic date.

Thanks for this info, ChelseaKate! I am still trying to get around with this idea of taxes and benefits. So small details get me confused sometimes. :)

Yeah. We heard from our lawyer that it can be something if we married in December 2013, Darnell. But we married this January.

Have to wait for next year in your case, December 31 is the magic date.

Awesome! Thanks again, Hank! good.gif

Yes. Reading too much threads confuse analytical minds. ;) Besides, I don't believe that all lawyers know everything. blush.png

oh - that's different then. If'n you don't like him, send him a letter of disengagement, requesting all original files back.

tax advice can be gotten from the scores of volunteer places in your locale, if'n you know how to look for them.
