Hey folks,

I am the Petitionar (DP) for my wife (SP) in India. Until last year I have been working part time while finishing my education. As I am filling for her affidavit of support, I realize my income of 13K in 2013 will not meet the poverty guide lines, and need to include my father's income (his income alone would meet the poverty guidelines) along with mien to reach the threshold.

My question is how can I go about filling my affidavit of support?

If I understand the instruction correctly, I can file the I-864 and have my father file the I-864A and submit both our forms as affidavit of support.

- The problem with this option is the diction of questions... The form first asks for INDIVIDUAL Income and then TOTAL income for part 1. My father has filled joint tax return with my mother since we immigrated to U.S. He is a self employed/business owner. How do I go about filling out this section of the form.

1. Do I seperate out his indiviudal income for each of the repoted year and use that as TOTAL income?

2. Do I use the total Income for both INDIVIDUAL and TOTAL section?

3. Do I use Individual income for Individual section, and their JOINT income as TOTAL income (even though my mother won't be part of the I864A)?

Also, I am unclear about the possibilities of having my father file the I-864 him self for my wife. Is that an option? Should I just have him file the I-864 on my behalf? If so, should I also include my income from 2011 and 2012 (2013 taxes will be filled shortly they will not meet the poverty line, I have job letter from my current employer that puts me well above poverty line in 2014). If I have him file I-864 what are some precaustions I need to make to ascertain the auditor clearly understands the household situation (A cover letter)? Will I also run into trouble of Joint Tax Return filling with I-864? Any advice on how to tackle this?

Thanks all for the support... we are so close to the finish line. I filled for her back in Jan 2013, and our progress has been putrid. We are JUST getting to the DS-260 forms now (All thanks to ATL field office).

Hello,

I am in the same situation as you. First...As the petitioner, you have to file the I-864. If you share the residence as your parents, he can file I-864 or I-864a, it does not matter. This much I have figured out until now. Some pepople have given me suggestions as submit the W2, paystubs and employment letter from my father to show individual income. As to what number to enter into part 6.13a,b,&,c...I have not received the answer yet. You should put the same question in March 2014 NVC filers sub-forum as I have done. Good luck to both of us.

First, do you life with your dad?

Second, why do you want to combine income if your dad can meet the I-864 requirements by himself?

IMHO, you are better off having your father file an I-864 as the Joint Sponsor and for his wife to file an I-864a as his household member.

You do not include mom's income in total income in dad's AOS.

Aah, thanks for your reply Aaron. I wasn't sure if it was possible for my parents to sponsor my wife (the definition of who is capable of sponsoring is very verbose).

Manan, I wasn't aware that sub forum existed. I will cross post this thread and hope to get more replies.

You can have 2 Joint Sponsors if there are more than 1 beneficiary. The Joint Sponors cannot combine income with each other. They split the beneficiaries between them.

For example; LPR petitions his wife (F2a) and his son. He can use 2 JSs; one for his wife and one for his son.

If there is only one beneficiary, there can only be one Joint Sponsor.

There is no limit in eligible household members.

However, combined income reaching the 125% poverty level with lots of household members does not make a strong case showing that there is financial support that makes the immigrant not likely to be a public charge.
